<br />ANDREWS: The Applicant I’d have to look that up I don’t have that. <br /> <br />VITOUSEK: Was that you Mr. Metzler? <br /> <br />METZLER: No, I can give you a little bit of background. Earlier I mentioned an unscrupulous <br />purchaser tied up the property, he is the person who instituted that ordinance and when we <br />purchased the property, we I think petitioned to and received one of them were the call voiding <br />that ordinance. <br /> <br />VITOUSEK: So, it was that previous owner, or the interim “- - -“. <br /> <br />METZLER: Yeah, he was the owner of record of the property, yes. <br /> <br />VITOUSEK: Okay. So, he received the Neighborhood Commercial zoning which only applied <br />to the portion of the property that is under the State Land Use urban district. Is that correct? <br /> <br />ANDREWS: Correct. <br /> <br />VITOUSEK: Okay, and then so Mr. Metzler after you purchased it you initiated the rezone back <br />to Ag zoning? <br /> <br />METZLER: Yes. <br /> <br />VITOUSEK: And what year was that? <br /> <br />METZLER: Well, I don’t know must have been in the late 90’s, I really don’t know. <br /> <br />ANDREWS: Oh, I can jump in because the official record is September 12, 2012 is the effective <br />date of the Change of Zone Ordinance Number 02 10 which was initiated by the Planning <br />Director. <br /> <br />VITOUSEK: Our background report indicates that was initiated by the Planning Director for <br />lack of compliance. <br /> <br />ANDREWS: And it reverted the previously zoned the CN zone area back to the original A-5a <br />zoning. <br /> <br />VITOUSEK: And so that that is sort of a discrepancy there, whether it was initiated by the <br />applicant in the late 90’s or whether it was a result of noncompliance by the applicant. Maija? <br /> <br />JACKSON: Yeah, Chair Vitousek I think our background report has an error, because it says <br />September 2012, but the ordinance is a 02 ordinance. So, I believe what probably happened was <br />the owner at the time I’m not sure if Mr. Metzler owned the property at the time but back in 2002 <br />the owner probably wrote in requesting that the ordinance be repealed and then the Planning <br />Director initiated that action. <br />15 <br />EXHIBIT C <br /> <br />
