So I <br />appreciate your question. <br />DOMINGO: Your boyfriend is Mr. Fogel? <br />POWELL: Mr. Fogel, that’s correct. <br />DOMINGO: Okay. You know, you mentioned about certain rules being changed. Could you <br />elaborate on that? <br />FOGEL: Well, there’s a requirement to establish the ocean shoreline which is trying to be <br />waived; and there’s probably other requirements in this package that are trying to be waived. I <br />don’t know, I haven’t read it. But if you look at it, I would guess that there are probably other <br />government regulations that are supposed to happen when you construct in a special <br />management area that are being waived in this case. And my opinion is it shouldn’t be, it’s the <br />government, they should follow the rules. <br />(Ms. Masunaga replaced Ms. Leithead Todd at this time, 12 noon.) <br />DOMINGO: I can understand what you’re saying if regulations or laws are asked to be waived <br />then they must, I think there must be some legitimate and important reasons for them asking for <br />that waiver. And I think -. <br />FOGEL: Yeah, the reason is they need to spend the money by a certain time. If they have to do <br />all the stuff they’re supposed to do they may not be able to meet the deadline for spending, <br />obligating the money. <br />DOMINGO: So them asking waiver of certain issues to be able to spend the money within a <br />certain time is an issue for you? <br />FOGEL: Yes, sir. <br />DOMINGO: In basic terms what are your feelings with regards to improving that particular <br />area? <br />FOGEL: That area is used, well, it would apply to local people quite frequently. It’s very <br />beautiful and it could be improved. The bath house that has basically just wasted away could be <br />turned into something like a pavilion, yes. It needs to be improved. It would be nice to have <br />bath houses or restroom facilities there, yeah. It would be nice to have a better sidewalk. You <br />could have a raised sidewalk that’s not affected by the roots, a boardwalk. There are other <br />alternatives to leaving the trees the way they are, leaving the layout the way it is and putting in <br />things that the public really needs, okay, rather than just cutting them all down and putting in <br />new trees. <br />DOMINGO: I’m going to ask you another similar question I asked your friend.
