BEFORE THE BOARD OF ETHICS <br />COUNTY OF HAWAI`I <br />In the Matter of the Petition by PETITION NO. 2021-12 <br />Joaquin (Joe) Belisario, <br />Petitioner. <br />ORDER DISMISSING PETITION <br />Initial Review: September 13, 2021 <br />ORDER DISMISSING PETITION <br />By Petition dated August 16, 2021, with the Hawaii County Board of Ethics (hereinafter <br />"the Board"), Petitioner Joaquin (Joe) Belisario (hereinafter referred to as "Petitioner") alleging <br />that a member of the County Council was in violation of the Hawaii County Code and Hawaii <br />County Charter, specifically, (1) "Sue Leeloy ignored the laws previously stated above and <br />should be held accountable for her actions to ensure the public's trust"; (2) "Leeloy failed to <br />make the required full disclosures of the above -mention instances to the council"; and (3) <br />"Leeloy's alleged affair with Neil Tanaka should also result in her removal of the Chair of the <br />Committee of Public Works and Mass Transit." <br />At its duly noticed meeting of September 13, 2021, the Board initially reviewed and <br />considered the above -captioned Petition pursuant to Rule 4 of the Rules of Practice and <br />Procedure of the Board of Ethics. Petitioner appeared in person and provided his testimony to <br />the Board. The Board also received and reviewed evidence submitted by the Petitioner. <br />Respondent appeared in person and provided her testimony to the Board. The Board also <br />received and reviewed evidence submitted by the Respondent. <br />Board member Denise Nakanishi moved to dismiss Petition No. 2021-12 based on <br />Petitioner's failure to establish the allegations listed in his Petition.
