ARAI: It is not a requirement for people or adjoining landowners to testify either <br />in support or against a particular project. And so it’s really at their discretion.It’s just that they <br />should be afforded the opportunity to comment if they so desire. <br />WATANABE: I think what Mr. Walter was alluding to, he was implying that based on the <br />information that he got, he’s not testifying that it’s true, based on the information that he got that <br />the County in their special use permit put a condition in there that restricted them from objecting <br />to traffic concerns. If it was in there, from my past experience it would be an unusual condition. <br />But, you know, you certainly have more experience than I do. <br />ARAI: Well, I’m not familiar with that special permit. Maybe Norman, could <br />you clarify? <br />HAYASHI: Yeah, I don’t know what the exact conditions of that particular special <br />permit are. But as you said it is, if it were imposed it is an unusual condition. I doubt it, I doubt <br />if the Planning Commission did in fact impose such a condition. <br />WATANABE: I think the other thing we should recognize is that Keaau is a small area. I <br />would assume that the majority of the students attending those schools live in relatively close <br />proximity to the area. I assume that as their parents bring them to the site that they’re going to <br />see a 3-foot by 4-foot sign that describes what is being applied for, etc. And so the general <br />public, whether they are notified by mail because they’re within 500 feet or not, typically should <br />be aware. And so if the parents themselves had any individual concerns I would think we would <br />have gotten some letters to that effect. <br />BOWMAN: Well, I just want to maybe comment on that. I know a lot of times things <br />that are given to the administration does not get to the parents. I’m not talking in any way -. But <br />that’s besides that. Again, the gray area is, what is that zoning between Ulupono -? <br />DARROW: That would be ML, Light Industrial. <br />BOWMAN: ML, Light Industrial. Well, how many acres? <br />DARROW: I’m not sure exactly how many acres; but it appears to be between 10 and <br />20 acres. <br />BOWMAN: I mean ML, wait. Isn’t the applicant asking for ML-1? <br />DARROW: Correct. <br />BOWMAN: Is that ML-1 or you don’t know? <br />DARROW: Well, I’m going to look right there. <br />BOWMAN: Oh, okay, sorry -. <br />WOODWARD: Well, let me, if I could just interject. Right now that area is zoned <br />Agricultural. But if you look at the LUPAG Map, it says Industrial, which includes things such <br /> EXHIBIT A <br />22 <br /> <br />
