Kuakini Highway. This identifies the Special Management Area line. Across from Kaiwi Street <br />is the entrance to the Kona Bay Estates. This morning we wereable to conduct a site inspection <br />of the property. As you enter into the Kona Bay Estates, this is identified here in the red dot. <br />Looking at the site plan this shows the proposed single family dwelling that is under <br />construction, a three-story single family dwelling. It also identifies the spa and, more <br />specifically, the swimming pool that is the object of the application this morning. The applicant <br />Dale Laurance is requesting a shoreline setback variance to be able to allow a minimum of 5 feet <br />within the shoreline setback area in lieu of the minimum requirement of 20 feet. Also, just for <br />clarification, this area along the south side of the property is a 10-foot public access right-of- <br />way, 5 feet of which is on the applicants property. And along the makai side of the property we <br />have a rock wall 2 feet in height, 2 feet in width; and this is also for public access purposes, also <br />located on the applicants property. <br />ThePlanningDirectorisrecommendingthatthisrequestbedeniedbythePlanningCommission. <br />Id like to also bring to your attention that weve received several new pieces of material from <br />the applicant and their representative, as well as an exhibit that has been submitted by the <br />Planning Department. Recently, the staff has learned that there was a previous shoreline setback <br />variance that was approved in the Kona Bay Estates on parcel 42. Weve submitted the approval <br />letter with conditions for you for your review. In lieu of this, the Planning Director still feels that <br />this request should be denied. <br />Wed like to make one change to the recommendation: On page 3, in the third paragraph on the <br />third line, theres the sentence that begins ‚The other developed lots which had received prior <br />approval for the construction of a swimming pool were located outside of the shoreline setback <br />area.ƒ Wed like to add in, ‚except for one of the lots.ƒ Are there any questions? <br />SIRACUSA:I couldnt find the exact spot where that is. <br />SPRINGER:Its on your yellow sheet. <br />DARROW:Sorry about that, the recommendation. <br />SIRACUSA;Ah, okay. <br />DARROW:These- has everybody received all the information that has been passed <br />out? <br />SPRINGER:Jeff, your reference to the other setback variance application is that the <br />correspondence to Mr. Lim? <br />rd <br />DARROW:Correct, dated January 3 <br />, 1995. <br />SPRINGER:Thank you. <br />DARROW:Thank you, Madam Chair. <br />2 <br /> <br />
