when we do allow an operation by special permit, we should have some basic safety <br />considerations here. <br />On the question of the letter that we sent and the photographs, I'd like to make this point, that <br />despite a long history, frankly, of violations and actions taken in bad faith by this particular <br />Applicant, the Planning Department recommended the approval of this permit with protective <br />conditions. The point in showing that they are using the public highway is not to show that <br />they are in violation of the permit but to show that they do park buses on the other side of the <br />highway. The one thing that I would ask the Commission, and say to the Commission on this <br />point is that it's not that I'm trying to penalize them for their violations. The violations are <br />done separately. The Commission is not involved up until the point at least where we might <br />bring an action to ask you to revoke the permit, which would be only up to this Commission to <br />do. The point is that we should not make a decision that's based on the good faith of this <br />Applicant in voluntarily complying with conditions. Do not pass something that would be <br />impossible to enforce that we expect them to simply follow because they are like the ordinary <br />person that we deal with where there is an element of trust and good faith. <br />FUJIKAWA:Any questions, Commissioners, to Mr. Yuen? Any other questions, Commissioner Kubota? <br />KUBOTA:What was the answer to that? <br />FUJIKAWA:I'm sorry? <br />KUBOTA:What was -? <br />O'TOOLE:Can we discuss it in Executive Session?
