Board of Ethics 04/01/2022 12:27 PM <br />Petition 2022-06: Request for an Informal Advisory Opinion of a Petition from an <br />Office of Housing Community Development employee seeking guidance on <br />whether a conflict of interest exists as Housing Specialist III who is looking to <br />obtain their Real Estate license to list/sell homes, some of which may be Section 8 <br />properties. <br />5. UNFINISHED BUSINESS <br />Petition No. 2022-02: Review Order Dismissing a petition from a County <br />employee requesting to volunteer on County of Hawaii board or commission. <br />b. Petition No. 2022-03: Review of Informal Advisory Opinion regarding a petition <br />from a County employee seeking guidance and clearance on Mayor's office <br />accepting donations for disbursement into the local community for two separate <br />events. <br />Continued discussion regarding a letter from Council member Sue Lee Loy to the <br />Board of Ethics regarding a request to expand their membership. <br />6. CONTINUED DISCUSSION REGARDING AMENDMENTS TO THE RULES OF <br />PRACTICE AND PROCEDURE OF THE BOARD OF ETHICS AND THE HAWAII <br />COUNTY CHARTER AND COUNTY CODE. <br />a. Continued review of Legal Opinion by Deputy Corporation Counsel Dakota Frenz <br />regarding whether Chair Heintz's proposed additions to the Code of Ethics are <br />consistent (or inconsistent) with the Hawai'i County Charter. <br />b. Consideration of Chair Heintz's proposed additions to the Code of Ethics Sections <br />for "Failure to Discharge" and "Appearance of Fairness Doctrine". <br />7. EXECUTIVE SESSION <br />With reference to agenda items listed, one or more executive meetings are anticipated. In <br />particular, the Board of Ethics anticipates it may consider the evaluation, dismissal, or <br />disciplining of an officer or employee of the County of Hawai'i, where considerations of <br />matters affecting privacy will be involved. The Board may also consult with the Board's <br />attorney on questions and issues pertaining to the Board's powers, duties, privileges, <br />immunities, and liabilities. Therefore, pursuant to Hawai'i Revised Statutes ("HRS") <br />Sections 92-5(a)(2), 92-5(a)(4), and 92-6(a)(2), the following items may be considered in <br />Executive Session. <br />Review of the executive session minutes of March 16, 2021. <br />b. Review of Confidential Financial Disclosure Forms filed pursuant to Section 2- <br />91.1(d), Hawai'i County Code, by County board and commission members and <br />designated County employees, where personal matters will be reviewed: <br />
