Again, this condition has not been fulfilled but will be done subsequent to <br /> issuance off nal subdivision approval. <br /> H. "All development generated runoff shall be disposed of on site and shall not be <br /> directed toward any adjacent properties. A drainage study of the project site, if <br /> required, shall be prepared for review and approval by the Department of Public <br /> Works,prior to submittal of plans for subdivision review. Drainage <br /> improvements, if required, shall be constructed in a manner meeting with the <br /> approval of the Department of Public Works prior to the issuance of Final <br /> Subdivision Approval." <br /> The originally approved construction plans did address this condition. This <br /> condition will continue to be addressed and complied with in the updated <br /> construction plans. <br /> I. "Vehicular access to Kaloko Drive shall be limited to one common driveway <br /> approach as approved by the Department of Public Works." <br /> This requirement has and will continue to be adhered to. It will be reflected in <br /> the final plat map and the construction plans. <br /> J. `Building permit for a residence will not be issued until improvements to the <br /> intersection at Mamalahoa Highway and Kaloko Drive are completed, provided <br /> that if the improvements are not completed within 24 months of the date of <br /> adoption of this ordinance, the applicant shall be allowed to proceed with the <br /> building permit. The improvements may include the following: 1) illuminate <br /> intersection at night; 2} installation of traffic signalization devices; 3) <br /> channelize turning movements at the intersection; and 4) provide other safety <br /> improvements, including appropriate line of sight distance requirements, as may <br /> be required by the State Department of Transportation." <br /> To date, the intersectional improvements have not been made. In the recently <br /> approved rezoning of this area (REZ 16-000206, Ord. 16 99) (Exhibit F), it <br /> was noted that there was more than S600,000 available for this work and thus <br /> concluded that continued contributions of the fair share requirement would be <br /> fair and adequate. Accordingly, the Applicant is requesting that this condition <br /> be deleted. <br /> K. "Should any remains of historic sites, such as rock walls, terraces, platforms, <br /> marine shelf concentrations or human burials,be encountered,work in the <br /> immediate area shall cease and the Department of Land and Natural Resources <br /> —Historic Preservation Division(DLNR-HPD) shall be immediately notified. <br /> Subsequent work shall proceed upon an archaeological clearance from the <br /> DLNR-HPD when it finds that sufficient mitigative measures have been taken." <br /> The Applicant will comply with this requirement. <br /> 5 <br />
