IV. RESTATEMENT OF REQUEST <br /> In the event this request is addressed as an amendment to Ordinance No. 06 82 as <br /> opposed to a new rezoning application, the Applicant requests the following: <br /> • Condition D: A 5-year time extension to secure final subdivision approval <br /> from the date of the amended ordinance with the possibility of an <br /> administrative time extension. <br /> ■ Conditions E and F: Deletion of the requirement to provide a copy of the <br /> recorded covenant prior to receipt of final subdivision approval. That would <br /> mean the deleting the last sentence and substituting it with the language <br /> similar to Ordinance No 16 99, in which case it would read: <br /> [A copy of the approved covenant(s) shall be recited in an instrument <br /> executed by the applicant and the County and recorded with the Bureau of <br /> Conveyances prior to the issuance of Final Subdivision Approval.] A copy Qf <br /> the recorded document shall be filed with the Planning De artment upon its <br /> receipt from the Bureau of Conveyances (Bracketed item to be deleted; <br /> underscored, proposed new language) <br /> Condition J: Deletion of Condition J relating to prohibiting any residential <br /> building permit pending improvements to the Kaloko Drive/Mamalahoa <br /> Highway intersection. This would make the request similar to Ord. No. 16 99. <br /> (See Exhibit F) <br /> Essentially, the amendments to Conditions E, F,and J are intended to make them <br /> consistent with the most recent rezoning conditions in this area, REZ 16-000206, <br /> Ord. 16 99(Exhibit F).The Applicant further understands that there may be a <br /> need to update other conditions, such as Condition L relating to the fair share <br /> value. <br /> V. INSTITUTIONAL CONSIDERATIONS <br /> A. State Land Use <br /> The entire site is within the Agricultural district. The proposed lot size (3+ <br /> acres)and intended use (family agriculture) would be consistent with the rules <br /> and regulations governing the State Land Use Agricultural District. <br /> B. County General Plan <br /> The County General Plan Land Use Pattern Allocation Guide(LUPAG)map <br /> designates Important Agricultural. Important Agricultural land is attributed to <br /> those lands with "better potential far sustained high agricultural yields because <br /> of soil type, climate, topography, or other factors.
