Condition P states the following: "In order to facilitate the timely construction of necessary improvements to the Mamalahoa Highway-Kaloko Drive intersection,the applicant shall perform conceptual design analyses and cost estimates for the intersection improvements meeting with the approval of the State Department of Transportation and the County Department of Public Works. The cost of this work shall be used to satisfy the applicant's fair share contribution. If it exceeds the applicant's requirements under Condition O, the excess shall be paid by fair share assessments previously collected by the County for improvements to the Mamalahoa Highway-Kaloko Drive intersection. The fair share contribution may be adjusted annually beginning three years after the effective date of this ordinance,based on the percentage change in the Honolulu Consumer Price Index (HCPI)." Per the enclosed letter dated July 14, 2006, the State Department of Transportation informed the Planning Department that the conceptual plans submitted by your engineers are conditionally approved. The Department of Public Works, per its letter dated July 31, 2006, stated that they are deferring all comments and recommendations to the State Department of Transportation since Highway 19 is a State road.
