Is this under the Code or is this under the <br /> Charter? <br /> MELLON-LACEY: Well, the Code spells out the criteria for the public hearings. <br /> KOSSOW: Right. <br /> MELLON-LACEY: And then it states in the Code that if you want to add additional <br /> criteria, the Commission could do that, but there's a timeframe which in that has to be <br /> done. You can't really implement it for the next, beyond a recommendation. `Cause it's <br /> not in the existing Code now, to add more public hearings. <br /> KOSSOW: Does the Code allow—and I apologize for my ignorance here. Does the Code <br /> allow to be amended by any sources besides us? <br /> MELLON-LACEY: To amend the Code you have to go through the Council. And that <br /> would have to be proposed and voted on. <br /> KOSSOW: If this Commission were to write a recommendation to the Council? <br /> MELLON-LACEY: You can make a recommendation. I just want to make sure that's <br /> clear, that it's going to be a recommendation. Because the way it was phrased, it sounded <br /> like there was some thinking that it was something you could just implement by vote. <br /> You can vote to make the recommendation, and surely present it that way. <br /> KOSSOW: Okay. So as for an idea flow chart here, the recommendation is made by this <br /> Commission. And it goes to the Council. Council will take that, and where does that go? <br /> MELLON-LACEY: Well, the Council would then have there would have to be work on <br /> specific wording for it and there would have to be a vote on it. <br /> KOSSOW: Okay. <br /> MELLON-LACEY: Sorry, it is also in the Charter too. That prior to completing a draft of <br /> the redistricting plan, the Commission shall hold at least one public hearing in each of the <br /> nine council districts. And upon completion, the Commission shall hold at least one <br /> public hearing in east Hawaii and one in west Hawaii. So, that's 3-17 (e). Sorry.
