Do you swear or affirm to tell the truth <br />now before the Hawaii County Planning Commission? <br />YUEN:I do. <br />LEITHEAD-TODD:I do. <br />ALAMEDA:Thank you. For the applicant, could you please state your name and <br />address for the record. <br />YOUNG:My name is Les Young, address is 500 Ala Moana Boulevard in Honolulu, <br />Hawaii. <br />ALAMEDA:Okay,Iknowyou€vebeenthroughthehearingandall.Arethereany <br />comments that you€d like to share with us or any thoughts? <br />YOUNG:Well, you do have quite a bit of information already from the documents <br />in front of you. What I€d like to do is just spend a few minutes giving you a very brief summary <br />of our proposal, and then make myself available for questions to then provide more specific <br />details to your questions. <br />ALAMEDA:I want to check with Corp. Counsel on, if you don€t mind, on me getting <br />clarity on how best to proceed. Mr. Torigoe, could you kind of lay it out for us? <br />TORIGOE:Sure. You€re in a situation where you now have a report and <br />recommendations and a proposed findings from the Hearings Officer, you also have a proposed <br />findings from the Department, and you have some exceptions from the intervenor. So you have <br />all that to consider. Under your Rule 4-33 when there are exceptions filed, the Commission may <br />render its decision based on the record, all the material that you have, or you can allow for oral <br />argument by the parties. You also can reopen the docket and take further evidence. So you have <br />some flexibility in doing these things. At this point, so I guess the initial decision is do you want <br />to make a decision based only on the documents and the record that you have, or do you want to <br />allow for oral argument and possibly further questioning of the parties? If so, then you should <br />have a motion to do that. <br />ALAMEDA:All right, fellow Commissioners, we can vote, we can basically make a <br />motion on what€s before us already, it€s Option 1. Option 2, we can allow for oral arguments <br />between the parties. And then Option 3, we could actually open it for testimony again.
