Is it still o <br />public to testify? <br />GALDONES:IÓm going to be asking if -. <br />KUBOTA:Okay, sorry. <br />GALDONES:Is there anybody else from the public who wishes to testify? If not, <br />Mr. Lim? <br />LIM:Thank you, Mr. Chairman. I think the best thing to do now i <br />assuming that the Commission is inclined to act favorably on this recommendation, weÓd <br />like to pass out some exhibits at this time and then march you t <br />approval, the comments to the conditions of approval, and give you the reasons why <br />weÓre requesting those amendments. <br />What theyÓre passing out to you now are, should be four exhibits. One is a February 3, <br />2003 Advertiser article indicating that the strength for the market and senior project is <br />booming. I think itÓs the right project at the right time. I think Mr. Cook is going to be <br />very successful. ThatÓs just for a general background on feasibility. <br />The second exhibit is a TMK map of 7-5-10 with the subject project outlined in yellow. <br />On the top of that youÓll see a stamp from the Department of Public Works indicating the <br />drainage ways that are near the subject property. ThatÓll be relevant to our discussion <br />among the condition changes. <br />The third thing are the archeological, the final data recovery plan that has been approved <br />by the State Historic Preservation Division dated July 2002 and the latest letter from them <br />of October 8, 2002 which indicates that they are recommending preservation of only site <br />No. 21762. <br />And the fourth thing is our proposed amendments to the conditions of approval. And <br />youÓll see the deletions that are shown by brackets and bold; and the additions are shown <br />by underlined and bold. <br />So if we go down the conditions, I think part of the theory on this is that weÓre looking at <br />creating a rezoning ordinance that will give us the opportunity to do both what we want <br />to do and what we might have to do. <br />And I think that leads to the first proposed change by the deletion of language from <br />Condition No. C. The deleted portion represents a request by the Applicant to not lock us <br />in a rezoning ordinance to doing the water system a certain way. And the reason for that <br />is that the, we know already the University of the Nations is co <br />18 <br /> <br />
