ALAMEDA: All right. My name is Kimo Alameda. I’ll be chairing this particular <br />agenda item. And before we start I’d like to just make sure for the record that my Fellow <br />Commissioners and the parties are okay with me chairing this particular agenda item. So if <br />there’s no objections to that, or are there any objections? Okay, seeing none, we can move <br />forward. <br />You know, I was talking to Ivan here regarding the rule for public testimony and at what part <br />does it come in since this is a contested kind of case. So let me just read to you, public testimony <br />here, 4-21. It says here, “The Presiding Officer shall afford all interested persons an opportunity <br />to present testimony on the matter prior to the commencement of the hearing and prior to <br />proceedings on any subsequent day to which the proceeding is continued.” So this tells me that <br />we should consider public testimony now. And that’s where I’m kind of leaning towards. So we <br />have four testifiers. So if there’s no objection to that? And I’m making sure I’m on track with <br />that, Mr. Torigoe? <br />TORIGOE: Yes. <br />ALAMEDA: Then I would like to just have the four testifiers come up and testify. <br />Seeing no objection, could I please call on Lillian Fox, Michael Reimer, Tom Walton, this says <br />“or”, or Brenda Walton. So I guess that meant “and.” Okay. <br />B. WALTON: Thank you. <br />ALAMEDA: Please raise your right hand. Do you swear or affirm to tell the truth <br />now before the Hawaii County Planning Commission? <br />TESTIFIERS: I do. <br />ALAMEDA: Thank you very much. I’d like to also share with you that we have a lot <br />of material on this particular agenda item, and this goes a while back. And so if you could please <br />limit your testimony to the facts and not try to, you know, I’m going to call a timeout that’s why, <br />if I see you go off on a tangent. So just be clear and concise. And if there’s any questions, we’ll <br />ask you those questions. So I guess we can start off on my far left. Could you please state your <br />name and address for the record. <br />FOX: Good morning. My name is Lillian Fox. I live at 75-6081 Alii Drive. I <br />am the president of the Board of Directors of the Alii Lani Homeowners Association. And this is <br />a condominium development of approximately 346 units. That’s a 1,000 people that live in <br />there. And we are directly impacted by the proposed development of Sunstone, LLC. In <br />addition to my position on the Board of Directors, I’m also the disaster preparedness coordinator <br />for this development; and, as such, we’ve had two indications since last we spoke, and that was <br />the tsunami that could have been generated by the 6.8 earthquake and also a tsunami warning <br />that occurred about two weeks ago on Sunday, and we were to stay tuned for further updates. <br />The people who run the restaurants on Alii Drive did not wait for further updates. They <br />evacuated their customers who were dining. And the overflow onto Alii Drive tied up traffic for <br />at least 20 minutes all the way down to Magic Sands. So we’re talking about a three-mile <br />backup, and there was no problem. <br />EXHIBIT B <br />2 <br /> <br />
