the initial application and whatever other evidence has been put into the contested case record, if <br />that is all still the understanding of the parties that the Commission will still have that to <br />consider. <br />LIM: Yes, that is the understanding of the Applicant. We would request that <br />since the Commission votes to approve intervention of the parties that we would like you <br />to take a formal motion to, I guess, vacate the intervention, or however you want to call it. <br />TORIGOE: Okay. Well, perhaps a motion to accept the withdrawal at this point. <br />ALAMEDA: Sure. I cannot do the motion. So, Fellow Commissioners? <br />Commissioner Iwashita. <br />IWASHITA: I’ll be happy to make the motion. <br />ALAMEDA: Okay, go ahead. <br />IWASHITA: Based on the agreement of the Applicant and the previously approved <br />Intervenor and the County, I move that the request for withdrawal of Intervenor status which the, <br />signed by apparently all members of the Hawaii Planing Mill Subdivision, and from what I see <br />it’s an undated document but has a faxed date of February 14, 2007, that the Commission accept <br />the withdrawal with the expressed understanding that all evidence submitted during the previous <br />contested case hearings would remain part of the record and that the Commission will also be <br />taking further evidence in this matter. <br />ALAMEDA: Very good. Is there a second? <br />WATANABE: Second. <br />ALAMEDA: Good. Motion made by Commissioner Iwashita, seconded by <br />Commissioner Watanabe.
