<br />one-half acre. Because, I mean, if you look at the plan you see how it goes. And you
<br />have the building, you have the driveway and the parking lot, thatÓs all used for the
<br />church. If he wants to just say, okay, you only take the footprint of the building, you only
<br />take the driveway and ignore the fact that youÓre really covering this much land, that I
<br />think thatÓs what heÓs saying; but that is not what RodneyÓs Declaration is saying. It is
<br />saying the church is one-half acre, the two structures are addit

<br />FIGUEIROA:Yes. IÓd like to, again, say that we accepted the way he calculated
<br />the footprint of the buildings and we then arrived at what his interpretation was as to how
<br />much land was being covered. I donÓt think Ms. OÓTooleÓs response changes that.
<br />Now, regarding the potential for this property that was mentioned about agricultural
<br />potential, we realize that many ag lands, and weÓd like to see more agriculture being
<br />developed, but still the fact remains that it is not an easy thing to do. And in this
<br />particular case, apparently, it is a very difficult thing to do to promote agriculture over all
<br />of these lots. Their history proves that.
<br />Now talking about the impact upon the Kauakea Community Association, I think youÓve
<br />heard testimony as to whether this association really has a right to control this particular
<br />road. In fact, if you look at the Hearings OfficerÓs response, he feels that each individual
<br />property owner has the right to do maintenance and improvements on that road. She
<br />doesnÓt say that they need the permission of the Kauakea Community Association. I
<br />mean, if you look at their history, the inactivity of that association and, all of a sudden,
<br />being resurrected for this particular proceeding, that would tell you something about that.
<br />So we feel that, as I stated earlier, I think weÓve met all of the criteria. WeÓd like to, o
<br />proposed Findings and Conclusions to be accepted as the Findings and Conclusions of
<br />the Planning Commission incorporating the particular Findings and Conclusions of the
<br />Hearings Officer to which we did not object and making that Decision and Order to
<br />approve this particular request by the Kamuela Congregation of JehovahÓs Witnesses.
<br />Again, IÓd like to thank you for your time and patience because we, as I said, IÓm not an
<br />attorney, we did the best we could to present what we feel is a reasonable case. And
<br />thatÓs all we can ask, a reasonable interpretation of the ordinance, and following through
<br />with your specific right to approve a Special Permit.
