G. All driveway connections and construction within the Ainaola Drive and Haihai Street <br /> Right-of-Way shall conform to Chapter 22, County Streets, of the Hawaii County Code. <br /> Access to Ainaola Drive and Haihai Street, including the provision of adequate site <br /> distances, shall meet with the approval of the Department of Public Works. <br /> H. Install streetlights, signs and markings, meeting with the approval of the Department of <br /> Public Works-Traffic Division. <br /> I. Based on current State Department of Heath wastewater rules, the project shall not <br /> exceed 33 single-family dwellings and 16 accessory dwelling units (ADU) also known as <br /> `Ohana dwellings. The 16 ADU's shall be assigned to specified lots by the applicant prior <br /> to Final Subdivision approval. Lots not specified for ADU's shall have restrictive <br /> covenants recorded against title to the property giving notice that the terms of the zoning <br /> ordinance prohibit the construction of ADU's and condominium property regimes. A <br /> copy of the proposed covenant(s)to be recorded with the State of Hawai'i Bureau of <br /> Conveyances shall be submitted to the Planning Director for review and approval prior to <br /> the issuance of Final Subdivision Approval. A copy of the recorded document shall be <br /> filed with the Planning Department upon its receipt from the Bureau of Conveyances. <br /> Should the State Department of Health wastewater rules change to permit more than 49 <br /> dwelling units to utilize individual wastewater systems (IWS) in the future this condition <br /> shall be automatically adjusted to the then current standards. Changes to any restrictive <br /> covenants on the individual lots based on a rule change would be on a first come first <br /> serve basis. All applicable State Department of Health and HRS Chapter 343 regulations <br /> shall be followed. <br /> J. All development generated runoff shall be disposed of on site and shall not be directed <br /> toward any adjacent properties. A drainage study shall be prepared by a professional <br /> civil engineer licensed in the State of Hawaii and submitted to the Department of Public <br /> Works. Any recommended drainage improvements, if required, shall be constructed <br /> meeting with the approval of the Department of Public Works prior to receipt of Final <br /> Subdivision Approval. <br /> -2- <br />
