15[4-3].To protect `6hi`a trees from Rapid `Ohi`a Death (ROD) on the subject property, the <br /> Applicant shall comply with the following protocols: 1)Prior to clearing the edges of the <br /> quarry, any isolated `6hi`a trees on the boundary will be identified. Any such trees that <br /> are not planned for removal on the edges of the quarry will be protected from disturbance <br /> entirely or cut and chipped or buried to ensure that they do not present a ready target for <br /> ROD infection that could spread to other trees; 2)treat any unavoidable scars on `6hi`a <br /> trees that result from clearing to prevent infestation of the fungus; 3) stack all removed <br /> `6hi`a trees and dispose of by burying or chipping; do not remove from project site; and <br /> 4) decontaminate boots and work tools before and after working in an area with `6hi`a <br /> trees. <br /> 16[4-4].In the event that surface or subsurface historic resources, including human skeletal <br /> remains, structural remains (e.g., rock walls, terraces, platforms, etc.), cultural deposits, <br /> marine shell concentrations, sand deposits, or sink holes are identified during the land <br /> clearing or quarry operations, the Applicant shall cease work in the immediate vicinity of <br /> the find, protect the find from additional disturbance and contact the State Historic <br /> Preservation Division at(808) 933-7651. Subsequent work shall proceed upon an <br /> archaeological clearance from DLNR-SHPD when it finds that sufficient mitigation <br /> measures have been taken. <br /> 17[4-5.].Within ninety (90) days after termination of the quarry operation or abandonment of the <br /> project site, the Applicant shall submit to the Planning Department appropriate <br /> documentation which demonstrates compliance with the DLNR approved closure/site <br /> reclamation plan. <br /> 18. Within four months from the effective date of this permit, the Applicant shall commence <br /> development of a permit site closure plan meeting with the approval of the State <br /> Department of Land and Natural Resources, in consultation with Keaukaha Pana`ewa <br /> Farmers Association (KPFA) and the Department of Hawaiian Home Lands (DHHL). <br /> The closure plan shall include mitigation efforts to leave the permit site in a non- <br /> hazardous condition. The closure plan shall include consideration for Hawaiian Home <br /> Commission Act(HHCA)beneficiaries, who reside or will reside in the KPFA <br /> community on HHCA lands in Pana`ewa. The method of permit site closure must not <br /> negatively impact HHCA lands or current/future beneficiaries. <br /> 19[46].The Applicant shall comply with all applicable laws, rules, regulations, and requirements <br /> of other affected agencies. <br /> 20[47-].Should any of these conditions not be met or substantially complied with in a timely <br /> manner, the Planning Director may initiate procedures to revoke this permit. <br />
