*** FOR PUBLICATION IN WEST'S HAWAII REPORTS AND PACIFIC REPORTER *** <br /> erroneous standard, pursuant to subsection (5) , and an <br /> agency' s exercise of discretion is reviewed under the <br /> arbitrary and capricious standard, pursuant to subsection <br /> (6) . <br /> Lana`ians for Sensible Growth v. Land Use Comm' n, 146 Hawaii <br /> 496, 502, 463 P. 3d 1153, 1159 (2020) (quoting Kauai Springs, <br /> Inc. v. Planning Comm' n of Kauai, 133 Hawaii 141, 164, 324 P. 3d <br /> 951, 974 (2014) ) . <br /> When interpreting agency rules, this court has stated <br /> that " [g] eneral principles of statutory construction apply, " <br /> which requires "look [ing] first at an administrative rule' s <br /> language . " Liberty Dialysis-Haw. , LLC v. Rainbow Dialysis, LLC, <br /> 130 Hawaii 95, 103, 306 P. 3d 140, 148 (2013) . <br /> If an administrative rule' s language is unambiguous, and <br /> its literal application is neither inconsistent with the <br /> policies of the statute the rule implements nor produces an <br /> absurd or unjust result, courts enforce the rule' s plain <br /> meaning. While an agency' s interpretation of its own rules <br /> is generally entitled to deference, this court does not <br /> defer to agency interpretations that are plainly erroneous <br /> or inconsistent with the underlying legislative purpose. <br /> Id. (internal citations and quotation marks omitted) . <br /> III . DISCUSSION <br /> A. The Instant Appeal is Not Moot; This Court May Exercise <br /> Judicial Review of Hualalai' s Appeal Pursuant to HRS <br /> §§ 205-19 and 91-14 <br /> 1 . Appellees' withdrawal of Special Permit Application <br /> No. SPP-16-188 does not render this case moot because <br /> Hualalai' s appeal presents a live controversy. <br /> Appellees contend that Hualalai' s appeal is moot <br /> because Special Permit Application No . SPP-16-188 has been <br /> withdrawn, thus ending Hualalai' s adverse interest in the case <br /> 21 <br />
