traffic to this project would come through a stubout on Mikilana Street, which was also of <br />a concern to the subdivision. And we also wanted to know the exact length of the <br />project. ThereÓs a certain phase thatÓs going to be involved here, and all the agencies are <br />going to be involved with the approval of this flood control channel, and what the timing <br />is for that. So the residents are very concerned about timing, <br />with the Applicant at a later date. <br />And we also have some concern about the project being turned over to the County of <br />Hawaii after this flood channel is completed, and what the housing development <br />proposals will be by the County of Hawaii. And we also have concern about, even <br />though this is a stubout at Mikilana Street, using this as an access through Mikilana and <br />to several other streets to gain access to the Kuakini Highway, which we believe would <br />impact traffic, and congestion, and noise, and perhaps create a nuisance in the <br />subdivision. <br />So those are some of the issues that we brought up at this time. <br />SPRINGER:Thank you, Mr. Ohan. At this time, I think it would appropriate <br />for the Commission to entertain a motion to continue this matter. I would inquire of staff <br />when our schedule is next clear to take this matter. <br />HAYASHI:ItÓs my understanding that the next meeting in West Hawaii would <br />th <br />be on April 4. Just as a matter of clarification, Madam Chair, I was just reviewing your <br />Contested Case ruling, rules, and it does state here that ÐUpon receipt of a written request <br />to intervene, the Commission at the first meeting on the matter shall hold a hearing on the <br />written request.Ñ So perhaps that should be deferred to Corporation Counsel for a <br />response as to whether that request for a Contested Case or a Petition for a Contested <br />Case Hearing should be taken up at this particular meeting. <br />SPRINGER:Thank you, Norman. Ivan, Mr. Torigoe? <br />TORIGOE:Yeah, the rule does say that. If, but then, also, I think the rules <br />allow for the parties to agree to modify the procedure. So if the parties would like to <br />simply put that issue of determining standing off to the next meeting, that can be done. <br />But if you prefer just, if the parties donÓt want to stipulate to that, then under the rules, <br />you probably should take it up now and decide whether standing is going to be granted. <br />SPRINGER:Mr. Ohan, what is your pleasure at this point? Would you like us <br />to make a determination on your application to be an intervenor in a Contested Case <br />th <br />Hearing, or would you like to use this time before our April 4 meeting to perhaps <br />negotiate and meet with the Applicant?
