maybe we should be working on that aspect of the Zoning Code,but, all right, be that as it may -. <br />That was the reason why when this proposal came up in 97 the Planning Director wouldnt <br />allow it without the General Plan Amendment. But they initiated a General Plan Amendment to <br />High Density Urban for the immediate area and then they processed the change of zone to CG; <br />and, essentially, were doing the same thing. <br />SIRACUSA:Okay. So to beat Commissioner Iwashita to the punch on this that we still <br />do not have a Community Development Plan for this area and things keep coming up, <br />recommendations and requests keep coming up in this area, without a Community Development <br />Plan to address that, it looks to me like were looking at spot zoning. And Im wondering, would <br />you say that its not spot zoning because the Big Island property adjacent has already been or <br />should -. You know, Im wondering if its the same owner do we really count that in as being a <br />consecutive property, that would, according to the rules, not then be spot zoning because its not <br />separated by anything else? Am I making myself clear? <br />YUEN:Yeah -. <br />SIRACUSA:Im not clear myself, so -. <br />YUEN:Well, its not spot zoning if its consistent with the General Plan; and so <br />youchangetheGeneralPlan,itsnotspotzoning.Thatsonething.Andthenitsadjacenttoan <br />existing facility. And we have to get down to the -. <br />SIRACUSA:Yeah, but its their own facility. Its the same owner, you know. <br />YUEN:Yeah, we have to get down to the real life of it, is that it is -. I mean from <br />the standpoint of what is the use of the property, I support it. And we really had no difficulty <br />with it from the beginning. The business is there, its a very busy location. If they had a <br />different site plan, for example, for example if they were doing just parking on the site, we could <br />have done it without a General Plan Amendment. We could have just done a zoning amendment. <br />But because of the production portion of it going on to the site, we had to do the zoning <br />amendment. But as far as just the use of the property, the location along Kekuanaoa Street, <br />which is one of the busiest streets in Hilo, adjacent to existing facilities, just an expansion of the <br />existing facility, we support it as far as the use of the property. We have to be consistent with the <br />Codes, the General Plan; and so were going through this double jump procedure rather than the <br />one jump of the rezone. <br />SIRACUSA:I have another question. <br />ALAMEDA:Commissioner Siracusa, follow-up? <br />SIRACUSA:Yes. I noticed that in our conditions of approval that are before us today, <br />there is no condition related to hours of operation. We have had conditions in the past for other <br />things where we looked at hours of operation and stated specifically what those should be. And <br />considering that we have had a complaint about hours of operation and that in their application it <br />says that during the holidays when theyre increasing production they would be working at night <br />shift also, I am concerned that we havent bothered to put something in about that. <br />7EXHIBIT C <br /> <br />
