SIRACUSA:Yes. I receivedtwo copies of the ordinance, one in white, the pink cover <br />sheet, and one in yellow. I only had timeto read the yellow one. Are they the same? <br />YUEN:Theyre practically the same. There are some slight changes in between <br />the two. <br />SIRACUSA:Could you outline those for me, please. <br />YUEN:On Section 23-63(1), thats on page 6 of your yellow, and this is a change <br />from, okay, this actually is a mistake in what we just did. Right now it says, ‚Proposed name of <br />the subdivision which shall not duplicate nor resemble the name of any other subdivision in the <br />County. The proposed name shall be subject to approval by the Director.ƒ After we circulated <br />the first set of amendments, we got a comment from one of our staff members that said we often, <br />a lot of subdivisions that we have, say, a two-lot subdivision, they dont have a proposed name. <br />Sowhatwewantedtodowaschangeitsoitdidntrequireaname.Sothisshouldactuallysay <br />‚Name of the subdivision, if proposed, which shall not duplicate.ƒ As far as what the Code <br />currently says, because it calls for a name of the subdivision, if somebody submitted a <br />subdivision that didnt have a name on it, again, thats a technical mistake; and its technically <br />wrong to have approved a subdivision without a name. Thats one change. So we would ask <br />that this be changed so that that language, that ‚if proposedƒ clause comes in so its not <br />mandatory that there be a name of a subdivision. <br />ALAMEDA:Very good. Other changes, if any? <br />YUEN:And in Section 23-65(3) on page 7, ‚Lots, showing approximate <br />dimensions,ƒ and weve changed the word ‚minimumƒ to ‚proposed lot size.ƒ And the Code <br />now, see, typically the subdivision will show a, say its a residential subdivision and theyll show <br />a lot and theyll say the lot is 10,700 square feet, and the Department will check back to make <br />sure that that conforms with the minimum lot size. For instance, if its an RS-10 zone, thats <br />okay. But if its an RS-15 zone, thats not okay. But we want them to show the actual lot size <br />rather than the minimum lot size because we have that in the zoning information. So thats why <br />we changed that from ‚minimumƒ to ‚proposed.ƒ And then we took out ‚proposed lot <br />numbers,ƒ we took out ‚block numbers,ƒ many subdivisions dont have block numbers, and then <br />put in if any, and thats just to say if any -. Okay? <br />On page 11, its just a, this is a very, the word ‚thereforƒ becomes ‚thereof.ƒ Thats a change <br />from the previous draft. <br />Those are the changes between the draft that you saw in Kona and the draft in yellow that you <br />have today. <br />ALAMEDA:Commissioner Siracusa? <br />SIRACUSA:So basically, for clarification -? <br />ALAMEDA:Sure. <br />SIRACUSA:The yellow draft is the more recent one, yes? <br />3EXHIBIT D <br /> <br />
