You know, with regards to the <br />zoning bill that is on the Council level right now, and should they go ahead and revoke the <br />zoning, actually what would be the status of that bill? Just be null and void and that’s it? And <br />then that SMA permit would be also null and void, and it will reflect that -, this will be reflected <br />in the General Plan? <br />RHO: Director Yuen, maybe you can answer that question for us? <br />YUEN: If the Council rezones the property to something that does not allow -, say, <br />the Commission today can revoke the SMA permit or it can pass an SMA permit contingent on <br />future Council action. If the Council then does not keep the zoning in place that would allow a <br />25-lot subdivision, then the SMA permit is null and void; it’s inconsistent with the zoning. None <br />of those actions will change the General Plan itself. <br />DOMINGO: But right now what does the General Plan permit -, what is permitted on <br />the General Plan for this specific parcel? <br />YUEN: The General Plan permits a range of things including a residential <br />development of up to 6 units per acre. It doesn’t compel that the zoning be any particular <br />density. <br />DOMINGO: That’s a very important point that I hope the Council can look at because <br />what we are doing is permitting or not permitting a development according to the General Plan. <br />EXHIBIT A <br />21 <br /> <br />
