Mr. Schneider, do you anticipate having legal <br />representation? <br />SCHNEIDER:No, I do not. <br />SPRINGER:Okay. Thank you. Mr. Torigoe, maybe you can explain that to the <br />panel and the applicants this matter of simplification of procedure. <br />TORIGOE:Right. Just very briefly, you should both get copies of the <br />Planning Commission Rule 4, which spells out the Contested Case procedures. Among <br />thoseproceduresareprovisionsthatyou,theparties,canagreetosimplifyprocedures. <br />So, you know, that€s something that you both, if you want to not have to hire counsel and <br />you have some ideas of how you€d like to make a simplified hearing, and you can agree <br />to that, that will work also. <br />SPRINGER:And, Mr. Torigoe, that could occur whether or not this panel hears <br />it or outsource it? <br />TORIGOE:That€s correct. <br />SPRINGER:Thank you. I don€t believe any of us, or the majority of us have <br />not sat as hearings officers. Could you sketch out for us, Mr. Torigoe, what that would <br />involve if the Planning Commission did take that up as a hearings officer? <br />TORIGOE:Sure. Very briefly, that would entail a trial-like procedure; but, <br />again, the parties can agree to a simplified procedure. It would generally involve the <br />making of some opening arguments or statements, presentation of witnesses, cross- <br />examine of witnesses, presentation of exhibits and other documentary evidence. Then the <br />answering of any questions from the Commission, and some closing arguments perhaps, <br />and then a decision-making. There could also be some written briefing of certain issues <br />if the Commission deems that necessary. But, again, it€s basically, you know, a trial-like <br />kind of a proceeding that can be simplified as well. <br />SALAVEA:Madam Chair? <br />SPRINGER:Commissioner Salavea? <br />SALAVEA:Just to clarify.
