I guess her concern here is that should <br />shegetherfacilitybuilt,she€sgoingtobeaccommodatinghandicappedpeople,thenthey€re <br />going to be walking in that area, and there€s a liability issue here. <br />SPRINGER:So the question is about the existing -? <br />OKURA:The conditions of the sidewalks in that area. <br />SPRINGER:Condition of the sidewalks down, with what Department might you take <br />this up, if not the Planning Department? <br />YUEN:Well, the maintenance is with the Department of Public Works. <br />LEAIRD-OKURA:Thank you. <br />SPRINGER:Commissioner Siracusa. <br />SIRACUSA:Yeah, I just wanted to mention that I know of several cases, certainly in <br />Pahoa, where the sidewalks are part of the, are owned by the property owners and not by the <br />County; and, therefore, it€s the property owners who have the responsibility for maintaining <br />them. But I think that€s a pretty rare situation; and I don€t know, possibly that might be the <br />reason for the Lyman ruling on the sidewalk.
