Supportive Information: The applicants have submitted the attached in support of <br /> the request: (Planning Department Exhibit 1 — Special Permit Application dated <br /> April 28, 2022.) <br /> BACKGROUND INFORMATION <br /> 7. November 23, 2020: The Planning Dept received a complaint which alleged the <br /> landowner was using the subject property to conduct a tennis lesson/school, without a <br /> Special Permit. A warning letter was sent by the Planning Department on November 10, <br /> 2021, followed up by an initial extension of time on December 13, 2021 and a second <br /> extension of time on April 19, 2022. The applicant has submitted the subject Special <br /> Permit application to resolve the violation. <br /> DESCRIPTION OF STATE & COUNTY PLANS <br /> 8. State Land Use District: Agricultural. <br /> 9. General Plan Land Use Pattern Allocation Guide (LUPAG) Map: Rural. <br /> 10. County Zoning: Agricultural-1 acres (A-la) and Agricultural-20 acres (A-20a). <br /> 11. Hilo Community Development Plan (CDP): The Hilo CDP, adopted as Planning <br /> Commission Resolution No. 1 on May 21, 1975, identifies the subject area for residential <br /> and agricultural use. <br /> 12. Special Management Area (SMA): The Special Management Area is a part of the <br /> Coastal Zone Management Program and regulated by the County. The subject parcel is <br /> located approximately four (4) miles from the nearest coastline and is not situated within <br /> the SMA. <br /> DESCRIPTION OF SUBJECT PROPERTY AND SURROUNDING AREA <br /> 13. Subject Property: The subject 1.003-acre property is improved with a 5-bedroom, 2- <br /> story, 3,256-square foot single-family dwelling, a 7,200-square foot, covered asphalt <br /> tennis court, a swimming pool, a gravel parking area, and a driveway. <br /> 14. Surrounding Land Uses/Zoning: Surrounding properties to the north, east and west are <br /> zoned A-la and most are also approximately one (1) -acre in size, while surrounding <br /> properties to the south are zoned A-20a and range in size from ten (10) to over twenty <br /> (20) acres.
