BKunimoto SPP.8.3.2022 COUNTY OF HAWAII PLANNING DEPARTMENT BACKGROUND REPORT RANDY KUNIMOTO SPECIAL PERMIT APPLICATION NO. PL-SPP-2022-000015 RANDY KUNIMOTO is requesting a Special Permit to legitimize the use of existing personal tennis court facilities, a portion of an existing dwelling, and related improvements to provide compensated tennis lessons to the public on approximately 1.003 acres of land in the State Land Use Agricultural District. The subject property is located at 1625 Mele Manu Street within the Pacific Plantations Subdivision, "Pacific Plantation", Increment 1-A, F.P. 1927, Kukuau 2nd South Hilo, Hawaii, TMK(3) 2-5-061:058. APPLICANT'S REQUEST 1. Request: The applicant is requesting a Special Permit to legitimize the use of existing personal tennis court facilities, a portion of an existing dwelling, and related improvements to provide compensated tennis lessons to the public. The applicant proposes to continue to provide tennis lessons to the general public at an existing tennis court located at the back of the subject property. Additionally, a portion of the existing dwelling will be accessed through an exterior side door, to provide restroom facilities to players. Other components of the project include an existing driveway and gravel parking area to accommodate eight(8) cars. 2. Staffing/Employees: The applicant will continue to employ three (3) coaches, including the applicant, in addition to several volunteer helpers as available. 3. Hours of Operation: Proposed hours of operation will be Monday through Friday, 8:00 am to 6:00 pm; Saturday and Sunday, 9:00 am to 6:00 pm. 4. Clients: The applicant anticipates approximately one (1)to eight(8) students per session and approximately eight(8) sessions per day, for a possible maximum of 64 students per day. 5. Construction Timetable: The applicant intends to complete the permitting process for the proposed use as soon as possible. Upon approval of the Special Permit, the applicant will immediately apply for Plan Approval, if deemed necessary, and complete modifications as required. -1- 6. Supportive Information: The applicants have submitted the attached in support of the request: (Planning Department Exhibit 1 — Special Permit Application dated April 28, 2022.) BACKGROUND INFORMATION 7. November 23, 2020: The Planning Dept received a complaint which alleged the landowner was using the subject property to conduct a tennis lesson/school, without a Special Permit. A warning letter was sent by the Planning Department on November 10, 2021, followed up by an initial extension of time on December 13, 2021 and a second extension of time on April 19, 2022. The applicant has submitted the subject Special Permit application to resolve the violation. DESCRIPTION OF STATE & COUNTY PLANS 8. State Land Use District: Agricultural. 9. General Plan Land Use Pattern Allocation Guide (LUPAG) Map: Rural. 10. County Zoning: Agricultural-1 acres (A-la) and Agricultural-20 acres (A-20a). 11. Hilo Community Development Plan (CDP): The Hilo CDP, adopted as Planning Commission Resolution No. 1 on May 21, 1975, identifies the subject area for residential and agricultural use. 12. Special Management Area (SMA): The Special Management Area is a part of the Coastal Zone Management Program and regulated by the County. The subject parcel is located approximately four (4) miles from the nearest coastline and is not situated within the SMA. DESCRIPTION OF SUBJECT PROPERTY AND SURROUNDING AREA 13. Subject Property: The subject 1.003-acre property is improved with a 5-bedroom, 2- story, 3,256-square foot single-family dwelling, a 7,200-square foot, covered asphalt tennis court, a swimming pool, a gravel parking area, and a driveway. 14. Surrounding Land Uses/Zoning: Surrounding properties to the north, east and west are zoned A-la and most are also approximately one (1) -acre in size, while surrounding properties to the south are zoned A-20a and range in size from ten (10) to over twenty (20) acres. Surrounding land uses are primarily agricultural and residential, with some 2 vacant, undeveloped parcels. The nearest dwelling is located approximately sixty (60) feet to the west of the subject property on TMK (3) 2-5-061:057. 15. Flood Insurance Rate Map (FIRM): The property is located within Zone "X," an area determined by FEMA to be outside the 500-year floodplain. 16. USDA Soil Survey Report: Soils on the parcel are classified as `Keaukaha' Series, described as highly decomposed plant material with 2 to 10 percent slopes; it is well drained with a high runoff. 17. Land Study Bureau's Overall Productivity Rating: "D" or"Poor". 18. Agricultural Lands of Importance to the State of Hawaii (ALISH): Unclassified. 19. Flora/Fauna Resources: No professional floral or faunal survey was conducted of the property as the subject property has been previously cleared for construction of a single- family dwelling and accessory structures. While the Department of Land and Natural Resources, Division of Forestry and Wildlife (DOFAW) recommended mitigation measures to protect listed or endangered species including the Hawaiian Hoary Bat or `Ope`ape`a (Lasiurus cinereus semotus), the Hawaiian Goose or Nene (Branta sandvicensis), the Hawaiian Hawk or Jo (Buteo solitarius) and seabirds, it is unlikely that such species are present as the subject property is fully built out. 20. Archaeological/Cultural/Historical Resources: According to the applicant, no formal archaeological studies have been conducted as the subject property is fully built out. There are no known historic sites on the property as listed on the State or National Register of Historic Places. There are no known valued cultural, historical, or natural resources on the property and no evidence of traditional and customary Native Hawaiian rights being practiced on the site. 21. Public Access: There is no known public access to the mountains or the shoreline that runs through the property. PUBLIC SERVICES AND FACILITIES 22. Access: Access to the subject parcel is provided by Mele Manu Street, a County- maintained road with a travel lane width of twenty (20)feet within a fifty (50)-foot wide right-of-way. Speed humps have been installed along the length of Mele Manu Street in 3 order to manage the speed of traffic along this particular roadway section. 23. Traffic: The applicant anticipates between 1 (one)to 8 (eight) clients per session, for a maximum of 64 clients per day. According to the applicant, sessions will be staged in order to allow players from one session to vacate the subject property and result in a maximum of 8 (eight) vehicles on the subject property at any given hour. According to the applicant, traffic in the surrounding neighborhood is generally low and made up primarily by residents of the area. 24. Water: According to the Department of Water Supply (DWS), the subject parcel is currently served by an existing 5/8-inch meter and the current average daily usage is less than 400 gallons. DWS has no objection as the proposed request has not generated a significant increase in water demand. 25. Wastewater: The subject property is currently serviced by an existing cesspool. According to the applicant, tennis players utilize the existing bathroom facilities within the existing dwelling. According to comments provided by the State Department of Health (DOH),to accommodate the increase in wastewater output, the applicant will be required to upgrade to a new wastewater treatment system meeting the approval of Subchapter 2, Chapter 11-62, Hawaii Administrative Rules. 26. Utilities: Electric and telephone services are available to the subject property. 27. Police, Fire and Medical Services: Police, Fire and Medical services are available nearby in Hilo. Location of Property The subject property is situated within the western section of the City of Hilo, a little more than 4.5 driving miles from Downtown Hilo and located off of Kaumana Drive at the mauka end of Edita Street, within the Pacific Plantation subdivision. The subject property is located at the western (mauka) end of Mele Manu Street, as shown below on Figure 1-Location Map and Figure 2-Vicinity Map below. 3. Landownership The subject property is owned by Randy and Leonora Kunimoto, both of whom have authorized the filing of this Special Permit application. B. STATEMENT OF OBJECTIVES AND PROJECT OPERATIONAL DETAILS 4. Statement of Objectives and reasons for the request The purpose and objective for requesting this Special Permit is to allow the Applicant to utilize a portion of his personal residence and existing tennis court facility, all of which are located on the subject property, to accommodate tennis lessons that will be offered to the general public. The tennis court itself is regulation size (36' x 78') and is situated at the back of the property and is not directly visible from Mele Manu Street. As the requested use is to utilize the Applicant's personal and existing tennis court to accommodate these lessons, there will be no reliance upon public tennis courts to accommodate this activity and thereby eliminate any potential conflicts between casual public and instructional tennis play upon any public tennis courts. _ p 4 Figure 1 - Location Map i oh SNP SUBJECT PROPERTY Figure 2—Vicinity Map 1Page STATEMENT FROM THE APPLICANT It all started when I had my first child. I, myself, started to play tennis from age 7 with unbelievable experiences throughout my entire junior years. I wanted my son to love the game of tennis. I also dreamed of having my own court as a child. Many of my peers, friends and competitors, had tennis courts at their homes. I always felt it was a huge advantage and just awesome to have your own court. It made a lot of sense to me since my wife (ex-wife now), mom, two brothers, niece, sister-in-law and a bunch of cousins all played tennis regularly. I built the court when I was a school teacher and started playing all the time with my family. I started working with friends and their families and pretty soon, I found that I not only loved playing tennis, but also loved coaching tennis. Although I had my Masters degree in education, I decided to leave teaching and teach tennis full time. I have worked with thousands of players from juniors all the way to senior citizens though all these years. I worked with the community, the University of Hawaii at Hilo, the Hilo Junior Tennis Club, East Hawaii District Tennis Association, Hui Kako'o Kenika and high school tennis. I, voluntarily, led at least 25 fundraisers through the years for various causes, including four huge fundraising events for those in the tennis community who were seriously ill. I love giving back to the community that treats me so well and gave me the opportunity to coach them or their child/children. Many juniors and adults in my program have been to National events and have gained invaluable experiences. The adults have been to places in Florida, Arizona, California, and Nevada to play tennis. Some of the juniors in my program have won State High School tennis championships or have placed in the top four; many received full or partial scholarships at colleges including Division I schools. Coming up to my property for tennis lessons has given many youngsters a safe and engaging place to be at after school. A few years ago, I introduced pickle ball as it was gaining in popularity among young and old alike, and I decided to incorporate it into my program. I had senior players and many retirees (some into their eighties) come and play at no charge. This was very well attended. However, due to complaints I received about traffic and noise, I stopped this, much to their disappointment, especially for those who had no other activity. I am currently looking at what I can do to surround as much of my court as possible to serve as a sound barrier. I have been, and am still trying my best to be a good neighbor and member of our community. To address concerns about the hours of my tennis lessons, I now end all lessons a couple of hours earlier than previously. I have already started to stagger my classes. For example, some classes may end at 4:15pm, and the next class start at 4:30pm. 2Page I had signs on my bulletin board reminding players to slow down on Mele Manu Street as well as signs reminding players about the speed limit. However, now there are speed humps along Mele Manu Street. My court has a Coverall cover which was put up in 2010 mainly to make a difference for all the players. I wanted the juniors to have successive practices which would assist in their player development, especially since it can continuously rain for days. Keeping kids off the streets and making a difference in their lives were and still are super important to me. The seniors also benefit from the cover since not playing in the hot sun was great for their health and well-being. In addition, a few come in for lessons from as far away as Ka`u; driving this far and in their seventies, and not having to face cancellation because of rain is definitely a huge plus. Having a covered court meant longer hours for the juniors, tennis rain or shine, and longevity and better quality of life for the seniors. In addition, building a cover meant that noise would stay in the dome, and most of the sound would not escape from the indoor court. I have tried to be good member of my Pacific Plantation community, and I must add that I am so appreciative of the many letters of support I've received from people in the community, including residents of Mele Manu, which I have included as Exhibit B— Letters of Support. About a month ago, I mailed letters to approximately 25 nearby neighbors which provided them with information about myself and asked them for comments before my application for a Special Use Permit was submitted. Thus far, I have received one response, and it was of support and encouragement. 5. Project Operational Details a. Overall Scope: Conduct tennis lessons available to the general public at an existing personal use tennis facility located on the subject property, as shown on Figure 3— Site Plan. The existing dwelling will only be utilized to provide restroom facilities to players, which is accessible via an exterior side door. b. Tennis Lesson sessions • Approximately 1 to 8 students per session • Approximately 8 sessions per day • Length of sessions: approximately 30 minutes to one (1) hour c. Project Timeframe Upon approval of the Special Permit, the Applicant will immediately apply for Plan Approval, if deemed necessary, and promptly provide any additional mitigating requirements as may be required as well as commence with tennis lessons as the existing tennis facility already provides for all necessary accommodations. C. LAND USE AND OTHER REGULATORY CONSIDERATIONS 7. General Plan Designation: Rural The County of Hawai'i General Plan is the policy document for the long-range comprehensive development of the island of Hawai'i. The General Plan Land Use Pattern Allocation Guide (LUPAG) map, as shown on Figure 4—General Plan LUPAG Map, classifies the subject property as RURAL. This RURAL category includes existing subdivisions in the State Land Use Agricultural and Rural districts that have a significant residential component. Typical lot sizes vary from 9,000-square feet to two acres. These subdivisions may contain small farms, wooded areas, and open fields as well as residences. Allowable uses within these areas, with appropriate zoning, may include commercial facilities that serve the residential and agricultural uses in the area, and community and public facilities. The Rural designation does not necessarily mean that these areas should be further subdivided to smaller lots. Most lack the infrastructure necessary to allow further subdivision. The subject property is located within Pacific Plantation Subdivision, an approximately 70-lot subdivision consisting of parcel no less than one (1) acre in size, and consistent with the type of subdivisions appropriate within areas designated for Rural uses by the General Plan. 8. State Land Use Designation: Agricultural The Project Site is situated within the State Land Use Agricultural District (see Figure 5 — State Land Use), which includes lands for the cultivation of crops, aquaculture, raising livestock, wind energy facility, timber cultivation, agriculture-support activities (i.e., mills, employee quarters, etc.) and land with significant potential for agriculture uses. Uses permitted in the highest productivity agricultural categories are governed by statute. Uses in the lower-productivity categories—C, D, E or U —were established by the Land Use Commission to include those uses allowed on A or B lands as well as those stated under Section 205-4.5, Hawai'i Revised Statutes. County Zoning: Agricultural-20 acres(A-20a) and 1 acre (A-1a) minimum lot sizes The Agricultural (A) zoning district provides for agricultural and very low density agriculturally-based residential use, encompassing rural areas of good to marginal agricultural and grazing land, forest land, game habitats, and areas where urbanization is not found to be appropriate. See Figure 6—Zoning. R5-10 A-1a fps, w R5-7.5 Figure 6—Zoning 10. Coastal Zone Management, HRS, Chapter 205A The entire State of Hawai'i lies within the Coastal Zone Management area. The intent of the Coastal Zone Management Program is to guide and regulate public and private uses in the coastal zone management area with respect to recreational resources, historic resources, public access to the shoreline, scenic and open space resources, coastal ecosystems, marine resources, economic uses, coastal hazards, managing development, public participation, and beach protection. 11. Special Management Area (SMA) The Special Management Area is a part of the Coastal Zone Management Program that is regulated by the County, established to promote the State's policy to preserve, protect, and where possible, to restore the natural resources of the coastal zone of Hawai'i. Therefore, special controls on development within the area along the shoreline are necessary to avoid permanent loss of valuable resources and the foreclosure of 7I management options, and to ensure that adequate public access is provided to public- owned or used beaches, recreation areas, and natural reserves, by dedication or other means. The subject property is located approximately 4 miles from the nearest coastline and at least 3.8 miles from the closest SMA boundary. D. DESCRIPTION OF PROPERTY AND SURROUNDING AREA 12. Project Site The subject property is completely improved as a single family residential homesite, as shown in Figure 3—Site Plan and Figure 7—Aerial Site and Tax Map Composite Plan. Existing improvements on the subject property include: a. 5-bedroom, 2-story, 3,256 square-foot single family dwelling constructed in 2002 (BP# 010763) b. Asphalt tennis court, approximately 7,200 square feet in size, constructed in 2002. (see Exhibit A-Photos of Existing Tennis Court) c. Swimming pool constructed in 2005 via BP# B2005-2512H d. Framed cover over tennis court constructed in 2010 via BP# B2010-0030H e. Sufficient on-site gravel parking for at least 8 cars. Surrounding Zoning/Land Uses The subject property is situated at the eastern (mauka) end of the approximately 70-lot Pacific Plantation Subdivision, consisting of similarly-sized parcels of one (1) acre in size. The subject property is bordered on either side by existing similarly-sized one-acre lots while the rear side backs up against private forested lands ranging in size from 10 to over 20 acres and zoned A-20a. 14.ALISH Soils within the Project Site are not classified by the Agricultural Lands of Importance to the State of Hawai'i. 15. Land Study Bureau's Detailed Land Classification System: "E" or"Very Poor" The soils within the Project Site are classified as Class "E" or "Very Poor" for agricultural productivity. 16. US Soil Survey: Keaukaha highly decomposed plant material-2 to 10 percent slopes Soils within the subject property consist of well-drained, thin organic soils overlying pahoehoe lava bedrock. These soils occupy the low areas of Mauna Loa and are located at an elevation ranging near sea level to 1,000 feet and receives from 90 inches to 150 inches of rainfall annually. The natural vegetation consists of ohia, tree fern, uluhe fern, and guava. These soils are used for woodland, pasture and homesites. 17. FIRM: Zone X The entire project site is designed within Zone "X" - determined to be outside the 500- year flood plain. There are no known drainageways traversing through the subject property. 18. Flora/Fauna Resources No threatened or endangered species of plants or animals are located within the subject property due to its extensive improvement as a single-family residential homesite. 19.Archaeological Resources An archaeological inventory survey of the subject property was not conducted as it has been significantly improved as a single family residential homesite along with a tennis court facility. 20. Cultural or Native Gathering Rights The development of the subject property as a single family residential homesite along with a tennis court facility offers no resources that could be gathered and utilized as part of any cultural or native Hawaiian practices. 21. Public Access There is no record of a designated public access to the shoreline or mountain areas that traverses through the subject property. 9Page E. PUBLIC UTILITIES AND SERVICES 22.Access Access to the Project Site from Kaumana Drive is provided by Edita Street and Mele Manu Street (see Figure 2—Vicinity Map), both County-maintained two-lane roads with a travel lane width of about 20 feet within a 50-foot wide right-of-way. Speed humps have been installed along the length of Mele Manu Street in order to manage the speed of traffic along this particular roadway section. 23.Traffic With 3 to 8 players during each session, a maximum number of 8 vehicles will be attracted to the subject property at any given hour. The Applicant will stagger the sessions in order to allow players from one session to vacate the subject property before the next session begins. 24. Water County water service supports the existing single-family dwelling and is available to support the limited water needs associated with conducting tennis lessons. No additional water service is necessary. 25. Wastewater The existing single-family dwelling is serviced by a cesspool. Tennis players utilize the existing bathroom facilities within the existing dwelling. 26. Solid Waste No significant amount of solid waste will be generated by conducting tennis lessons on the existing tennis court, as most players bring their own water bottles. 27. Essential Utilities and Services Typical utilities, such as electrical and telephone services, are already available and servicing the existing single-family dwelling. The requested use of the existing tennis court for tennis lessons require lighting during early evening hours, although ending formal tennis lessons by 6:00pm would typically preclude the need for such lighting except during very inclement weather. 28. Public Safety As the Project Site is located within the City of Hilo, police, medical and fire services are readily available. 10Page F. STATEMENT OF REASONS IN SUPPORT OF GRANTING SPECIAL PERMIT 1. Such use shall not be contrary to the objectives sought to be accomplished by the Land Use Law and Regulations The request is considered an unusual and reasonable use of agricultural lands. The requested use will not adversely affect the preservation and agricultural use of the County's limited prime agricultural lands and therefore, is not contrary to the objectives sought to be accomplished by the State Land Use Law and regulations. The General Plan identifies the subject property and the rest of the Pacific Plantation Subdivision as Rural, which is typically defined as homesites varying in size from 9,000-square feet to two acres. These subdivisions may contain small farms, wooded areas, and open fields as well as residences. Allowable uses within these areas, with appropriate zoning, may include commercial facilities that serve the residential and agricultural uses in the area, and community and public facilities. The Applicant wishes to utilize his existing tennis court facility by offering tennis lessons to the general public. Use of the existing facility will not require any additional land to be committed for non-agricultural purposes and will not compromise the island's inventory of valuable agricultural lands. While the State Land Use Designation is Agricultural, the existing one-acre lot size of the subject property and its surrounding Pacific Palisades Subdivision along with the General Plan Rural designation suggest otherwise by being largely residential in purpose with limited opportunity for extensive or intensive agricultural uses simply due to the small lot size typically accommodating single family residential and related uses. 2. The desired use shall not adversely affect surrounding properties The subject property is situated at the eastern (mauka) end of the approximately 70-lot Pacific Plantation Subdivision, consisting of similarly-sized parcels of one (1) acre in size. The subject property is bordered on either side by existing similarly-sized one-acre lots while the rear side backs up against private forested lands ranging in size from 10 to over 20 acres and zoned A-20a. The existing tennis court is located at the rear of the property facing the large forested lands, and not directly visible, for the most part, from Mele Manu Street. Traffic and noise associated with conducting tennis lesson on the subject property are the two concerns that could create a significant adverse impact upon neighboring properties or to other residents of Pacific Plantation Subdivision that use both Edita and Mele Manu Streets. In order to minimize such potential impacts, the Applicant agrees to: a. cease all lessons at 6:30pm, from its previous 8:30-9:30 pm ending time. b. stagger sessions to reduce overlap of traffic and players arriving or leaving the subject property at any given time. c. prohibit the playing of music or other amplified forms of sounds as part of the tennis lessons. 11Page With these measures in place, the Applicant believes that traffic and noise will be kept to reasonable levels. As the Applicant is the coach, he will instruct his players to follow his rules at all times. 3. Such use shall not unreasonably burden public agencies to provide roads and streets, sewers,water, drainage, school improvements, and police and fire protection The request to allow tennis lessons to be conducted at the Applicant's home and on an existing tennis court is fully supported by existing utilities and services as the subject property is located in the City of Hilo, where such services are readily available. Due to staggered scheduling of tennis sessions, there would be no more than 8 vehicles traveling to or from the subject property at any given time. Both Edita and Mele Manu Streets are in good condition and able to support the level of traffic anticipated to be generated by the conducting tennis lessons on the subject property, especially when considering that these roads also provide access to the approximately 70 lots within Pacific Plantation Subdivision. 4. Unusual conditions,trends, and needs have arisen since the district boundaries and regulations were established The State and the County, through its land use laws, have the fiduciary responsibility of protecting its important agricultural lands located in limited quantities throughout the state. In this particular area within the City of Hilo, the subject property and its immediately surrounding area were developed as part of the 70-lot Pacific Plantation Subdivision consisting of one-acre parcels. Clearly, the subject property and the subdivision as a whole does not present any significant agricultural potential as witnessed by the designation of the entire subdivision for Rural uses by the General Plan. The subject property is fully improved with a single-family dwelling and various recreational facilities, such as a swimming pool and a tennis court. Approval of the requested Special Permit to allow the Applicant to conduct tennis lessons on the existing court will not have any material effect upon the State and County responsibility in protecting its valued agricultural lands. The subject property, from the standpoint of potentially supporting any reasonable agricultural use, has already been compromised due to its improvement as a single-family residential homesite. 5. The land upon which the proposed use is sought is unsuited for the uses permitted within the district The Project Site is currently not used for any agricultural purpose and fully improved as a single-family residential homesite along with a swimming pool and tennis court facility. For this reason, the subject property is not identified as important agricultural lands by both the State or County. As discussed above, the subject property, from the standpoint of potentially supporting any reasonable agricultural use, has already been compromised due to its improvement as a single-family residential homesite. 121 Page 6. The proposed use will not substantially alter or change the essential character of the land and the present use The Applicant and his entire family and circle of friends are avid tennis players. Therefore, the existing tennis court does accommodate frequent personal use for casual play. The potential concerns arise when the introduction of formal tennis lessons exceed the typical characteristics of casual play. As the tennis lessons will be conducted on and within the existing tennis court facilities, the essential outward character of the subject property will not physically change. Arriving players will park on the subject property and not on Mele Manu Street. The tennis court is covered as well. Therefore, the physical attributes of the subject property as a single-family residence will not significantly change. What will change are the characteristics on how the tennis court facility is being utilized to accommodate tennis instruction. Obviously, there will be more frequent use of the tennis court, which translates to more people and vehicles coming to and going from the subject property. Along with more people visiting the property is the potential for more constant noise and traffic. The Applicant has been implementing various measures to address these potential adverse effects on the character of the immediate and surrounding area by limiting the hours of instruction and staggering the sessions to avoid overlapping the traffic and people at the subject property. Covering the tennis court has not only helped with inclement weather, but has also helped to mitigate the transmission of noise. Operational restrictions, such as eliminating pickle ball activities during the evening hours and restricting the playing of music during lessons will further mitigate the potential of noise impacts upon surrounding properties. 7. The reauest will not be contrary to the General Plan and official Community Development Plan and other documents such as Design Plans In considering the issuance of a Special Permit to allow a particular use, it must be assessed against the applicable goals, policies and standards of the General Plan. It is only through a comprehensive policy analysis approach that evaluations and decisions can be made to better time or stage developments to achieve quality growth. The implications of these evaluations and decisions must also be considered as they may have an impact on other similar areas in the County. Land use is one of the principal focal points of public concern and policy. The Land Use Element of the General Plan provides the primary basis for direct control and guidance of publicly and privately owned resources. It is also intended to be used as a policy guide for the coordinated growth and development of all sectors of the County. It sets forth goals, policies, standards and courses of action to accommodate growth without congestion, to designate and preserve the lands needed for residential use, commercial 13 Page and visitor services, industry, agriculture and open space, and to coordinate these uses with the County's service and circulation systems. The overall Land Use goals, policies and standards are set forth to physically plan the lands in the County in the best interest of the island's residents. In addition to its goals, policies and standards, the General Plan also includes the Land Use Pattern Allocation Guide (LUPAG) Map, which is a graphic representation of the document's goals and policies to guide the coordinated growth and development of all sectors of the County by presenting a graphic depiction of the physical relationship among the various land uses. The LUPAG Map establishes the basic urban and non- urban form for areas within the County. The General Plan LUPAG Map designates the subject property and the rest of the Pacific Plantation Subdivision as "Rural', which is appropriate given the one-acre lot sizes and predominately single-family residential use within this long-established subdivision. The requested use, along with the implementation of proper mitigation measures, would complement the following goals the Land Use and Economic elements of the General Plan: Land Use: • Designate and allocate land uses in appropriate proportions and mix and in keeping with the social, cultural, and physical environments of the County. Economic: • Economic development and improvements shall be in balance with the physical and social environments of the island of Hawaii. While the subject property maintains an Agricultural designation by the State Land Use Commission, the General Plan does designate these lands for Rural uses. The request to utilize an existing tennis court to conduct tennis lessons that are open to the general public will not compromise the goal of the Agricultural element of the General Plan to "Preserve the agricultural character of the island". Pacific Plantation Subdivision, within which the subject property is located, is a rural subdivision and not designed to accommodate any significant amount of extensive or intensive agricultural activities. 14Page G. GROUNDS FOR APPROVAL OF A SPECIAL PERMIT (Planning Department Rule Section 6-7) The Planning Commission shall not approve a Special Permit unless it is found that the proposed use: 1. Is an unusual and reasonable use of land situated within the Agricultural or Rural District, whichever the case may be. In recognizing that lands within Agricultural districts might not be best suited for agricultural activities and yet classified as such, and in recognition that certain types of uses might not be strictly agricultural in nature, yet reasonable in such districts, the Legislature has provided for the Special Permit process to allow certain unusual and reasonable uses within the Agricultural district. Based on existing and substantially improved nature of the subject property as a homesite that restricts any opportunity to conduct meaningful agricultural activities, the Applicant finds that allowing tennis lessons to be conducted on an existing tennis court facility is considered an unusual and reasonable use of agricultural land within the State Land Use Agricultural District within this particular section of the City of Hilo. 2. Would promote the effectiveness and objectives of Chapter 205, Hawaii Revised Statutes, as amended. The State Land Use Law and Regulations are intended to preserve, protect and encourage the development of lands for those uses to which they are best suited in the interest of the public welfare of the people of the State of Hawai'i. In the case of the Agricultural District, the intent is to preserve or keep lands of high agricultural potential in agricultural use. Soils within the Project Site are identified as being of the Keaukaha series which are mostly covered in woodland, pasture and homesites. These soils are classified as "D" or "Poor" soil by the Land Study Bureau's Overall Master Productivity Rating. Most significantly, however, is simply the fact that the subject property is extensively improved as a single-family residential homesite that also accommodates a tennis court facility. Therefore, the issuance of a Special Permit to allow the Applicant to conduct tennis lessons on an existing tennis court facility will not displace any existing agricultural activity nor adversely affect the preservation and agricultural use of the County's prime agricultural lands, and is not contrary to the objectives sought to be accomplished by the State Land Use Law and Regulations. 15 Page H. COASTAL ZONE MANAGEMENT The requested Special Permit, if approved, will not be contrary to Chapter 205A, Hawaii Revised Statues, relating to Coastal Zone Management. The subject property is not situated within the Special Management Area, being located about 4 miles from the nearest shoreline and is not subject to any coastal hazard nor anticipate to have any adverse impact upon coastal resources such as coastal recreational and marine resources, coastal ecosystems or the public use and recreational use of any beach. There is no record of a designated public access that traverses the subject property, which is maintained as a private residence. As the subject property has been extensively altered and improved as a residential homesite, the Applicant can definitely confirm that native Hawaiian cultural practices are not being exercised within the subject property. Therefore, it is not anticipated that approval of the request will have any adverse impact on cultural or historical resources in the area. The subject request is limited in scope: to allow for tennis lessons to be conducted on an existing tennis court facility located at the Applicant's home. No additional land, natural resources or public services and utilities will be required in order to support the requested use. Therefore, this request is supportive of the County's efforts towards properly managing development. Finally, in terms of the public participation objective, this is generally a public agency function. This is achieved through the Marine and Coastal Zone Management Advisory Group (MACZMAG) and the public hearing process required pursuant to the Planning Commission's Rules and County Council's meetings on this application. Notices of this application will become available through the posting of a sign on the property, as well as sending two (2) notices to surrounding property owners, one at the time the application is filed and again, prior to the public hearing. In view of the Hawaii State Supreme Court's "PASH" and "Ka Pa`akai O Ka `Aina" decisions, the issue relative to native Hawaiian gathering and fishing rights must be addressed in terms of the cultural, historical, and natural resources and the associated traditional and customary practices of the site. As the subject property is located about 4 miles from the shoreline and has been significantly altered to accommodate the existing single family dwelling, swimming pool and tennis court, the Applicant finds that no valued cultural, historic, or natural resources related to traditional and customary practices were identified within the subject property, and no traditional and customary native Hawaiian rights are exercised therein. For similar reasons, the Applicant could not identify any such valued resources within the subject property. For these reasons, the Applicant could find no evidence of any possible significant adverse effects or impairments that will occur to any valued resources should this Special Permit request be approved. While no on-site improvements are anticipated as part of this request, should the Applicant inadvertently encounter any remains of historic sites, such as rock walls, terraces, platforms, marine shell concentrations or human burials, the Applicant 16Page agrees to cease work in the immediate area and contact the Department of Land and Natural Resources-State Historic Preservation Division (DLNR-HPD), resuming activities only upon securing archaeological clearance from DLNR-HPD when it finds that sufficient mitigation measures have been taken. I. Three years ago Randy introduced me,a 50+year old with a"dad bod,"to the sport of pickleball. With group instruction and fun play for adults in the early evening after work, I quickly learned to trove the sport. it's inspired me to change my diet and exercise regularly, enabling me to improve my physical and mental health. About a year after introducing me and others to pickleball, Randy received a complaint from one of his neighbors.As pickleball is played with a hard plastic ball, not a felt tennis ball,the noise from the pickleball play at night was too loud. Although the issue was raised from just one neighbor,and after inquiring no other adjacent neighbors minded, in an abundance of caution and concern Randy cancelled all evening pickleball and cut back tennis instruction to end by Spm. Personally I was devastated but found other places to play, and my son's lesson's times shifted, but I thought it was commendable of Randy to hear the concern from this one neighbor and do what was needed to mitigate the concern. That's why it is completely surprising to me that this is still being raised as an issue. If you surveyed the whole Mele Manu Street neighborhood you would only find one resident with concerns. I have known Mr. Kunimoto for over 20 years. First, as a teacher at ft Ikea Intermediate School, a co-worker for 8 years before he left to open his business. During the 6 years he was an excellent teacher for the students of middle school age. He cared for their intellectual education, social and physical development of growing into weII rounded students. When he opened his business he was able to reach all individuals from age 4 to 80 plus for the Iast 18 to 20 years. In my eyes Mr. Kunimoto is a superstar with tons of love and aloha . His fees are very minimal. For example a charge of $20.00 is for an hour, but his hour turns into extra 30 to 45 minutes; sometimes 2 hours. Many other coaches or facilities would charge double or triple his fee. Often when it rains and the County Indoor Tennis facility is not available, Mr. Kunimoto aIIows the University of Hawaii Vulcan Tennis team the use of his court with no cost to the program. With out Mr. Kuimoto's facility the Vulcans would not have reached the NCAA championships, and recognize Hilo, Hawaii on the map. An example of successful tennis individuals is the Vulcan tennis coach, KaIIen Mizuguchi who had gone though coach Kunhoto's program as a youngster. Today there are many college students who participate in Division I and 11 tennis teams on the mainland. The Hilo community have been recognized for its tennis success in the state and national level. Many can never know the amount of patience and hours it takes to instruct thousands of individuals; on a daily basis, yearly. It's a shame if Mr. Kunimoto will need to shut down his business after 20 plus years, only because of one neighbor who has been unhappy and complained in recent years. Mr. Kunimoto has addressed every issue brought to his attention, some were absurd request which eliminated some programs. This neighbor has also been unhappy with others that live around him. Closing Mr. Kunimoto's business will be devastating not only to the business , but the future of our community. There will be no youngsters who will participate in the Junior Tennis Program, which he has put in countless hours. High School 3 tennis and students attending college will be affected. Older adults who enjoy tennis and belong to the USTA leagues will be affected. This season of thankfulness and love, let us be grateful for Mr. Kunimoto has contributed so much to our community. 2012 the University of Hawaii Hilo Athletic Hall of Fame, recognized Randy Kunimoto for his tennis dedication to our community. I have coached for a number of years (at different levels) In a different sport,but Randy's Tennis is a different environment than other businesses that provide individual and small group instruction. In a lot of the other businesses,the main focus is to develop the skills in players so that they can be successful and compete at the highest level. Although Randy's program has been successful at developing tennis players that are able to play at a high competitive level in High School,Junior Tennis, and evert college, Randy's program is special. He is a coach that is always providing positive feedback to his players,yet expects them to work hard each time they step on the court. He is always attuned to his players, making sure that they are balanced physically, mentally,and emotionally. My daughters have been a part of the program for about 8 years. They compete in Junior Tennis tournaments throughout the state and experience the pressures of playing in these types of tournaments. Watching them play in these tournaments, where players make their own calls and the integrity of the sport is often overcome by the "competitive spirit", Randy has always been there to reinforce to my daughters the importance of integrity and good character. In a recent tournament,an official carne up to my wife and complimented my daughter on her fair calls and how she acts on the court. This is entirely due to Randy's work. On countless occasions,during lessons, he would talk to her and reinforce the importance of making good calls and playing the game with integrity. This speaks volumes to the type of environment that Randy has built at Randy's "Tennis. These traits that he tries to instill in his player go past the sport of tennis and will benefit them in whatever future endeavor they wish to pursue. But the most important benefit for my daughters is that handy has been an awesome advocate for my daughters. As stated before, my daughters compete in junior tennis tournaments. Because these tournaments are so competitive,the players are put under an immense pressure to do well. It is a difficult situation to put an 11 or 12-year-old and expect them to do well. As a parent, wanting them to do well, I added to the pressure and my daughters did not handle it well. I know it is always difficult to go up to a parent, but Randy saw that my daughters were in a negative situation and for their benefit he was able to talk to me and help me with my daughters. Knowing the type of person that Randy is, he would do this for any one of his players. I believe that my daughters and I are in a better situation now, but we are still working on it. He is a valued friend that continues to help me with my relationships with my daughters. I honestly don't know where we would be had he not taken the time to be an advocate for my daughters. I also go to tennis on Sundays between gam ' and 10:45am.Coach Randy's Tennis provides me with physical activity,stress relief,and a place to laugh. Currently, at my intermediate school,I have no P.E.class scheduled this school year.The recommended physical activity for my age group is 60 minutes of moderate to vigorous activities per day. Coach Randy's Tennis provides me with physical admty that I need,rain or shine.All of the public tennis courts in Hilo are outside,but Coach Randy's court is covered.Therefore vire can play tennis even in the usual rainy weather in Hilo. I am a teenager and have some stressful days at school. However,when I get to the court,I focus on tennis,and tennis helps me forget about bad things.After tennis, I am relaxed and fess bothered by the troubles happening at school.When i go home after tennis practice,I can focus on my homework and be ready to share my day with my parentis. At Coach Randys,l have friends and coaches with whom t can joke and laugh.In addition, there are some boys and girls I have grown up with in my tennis classes through tennis outside of school. We play team games against each other,play tennis tricks on each other, and decide the loser team's punishments(pushups,squats,shuttle runs,etc).We are competitive,play hard,and laugh hard on the court together. The proposed project consists of allowing the applicant to utilize a portion of his personal residence and existing tennis court facility, located on the subject property, to accommodate tennis lessons that will be offered to the general public. Thank you for the opportunity to review and comment on the subject matter.Since no site development or improvements will be taking place at the site,DOFAW has no current comments regarding impacts to listed species. In the event that the scope of the project changes significantly,however, or should it become apparent that threatened or endangered species may be impacted,please consider the following recommendations regarding the potential listed species that may occur in the vicinity of the project area. The State listed Hawaiian Hoary Bat or `Ope`ape`a (Lasiurus cinereus semotus) could potentially occur at or in the vicinity of the project and may roost in nearby trees.Any required site clearing should be timed to avoid disturbance to bats during their birthing and pup rearing season (June 1 through September 15). During this period woody plants greater than 15 feet (4.6 meters) tall should not be disturbed,removed,or trimmed. Barbed wire should also be avoided for any construction because bats can become ensnared and killed by such fencing material during flight. Artificial lighting can adversely impact seabirds that may pass through the area at night by causing them to become disoriented. This disorientation can result in their collision with manmade structures or the grounding of birds. For nighttime work that might be required, DOFAW recommends that all lights used to be fully shielded to minimize the attraction of seabirds. Nighttime work that requires outdoor lighting should be avoided during the seabird fledging season, from September 15 through December 15. This is the period when young seabirds take their maiden voyage to the open sea. I applaud the effort by the county and I am expressing my opposition to granting the owner a special use permit. Pacific Plantation was a very special place. A very quiet neighborhood with great neighbors. Until 15 years ago when Randy Kunimoto erected his tennis court and started to offer tennis lessons as a business. He lives at the top of Mele Manu and offer his tennis lessons out of his residence. There is only one way in and one way out of the road. It is because of his tennis clients that he had single handedly increased the traffic by 300 percent. He turned a quiet neighborhood into a thorough fare. He has some good clients and some terrible clients that do not respect the neighborhood. Before the speed humps were installed on the road I have clocked some of his client traveling in excess of 50 mph. Mele Manu Street has a 25 mph speed limit. That was totally unsafe! There were two incidences when I was walking in the evening on the shoulder of Mele Manu Street and I was almost hit by his clients. I spoke with Randy regarding his control over the driving habit of his clients. He turned around and changed the subject and deflected his responsibility. The neighborhood rally for speed humps on the road and thanks to the county they were installed and the vehicular speed had reduced a lot. However the driving habit and number of vehicles had not decrease. Randy's client had at times tail gate other vehicles driving up Mele Manu because they were late for their lessons or in a rush. That makes the neighborhood very unsafe because of his business. This is in additional to the noise his business generates around the neighborhood. This goes on all hours of the day from early in the morning to late at night. The neighbors had to rise up and wrote letters to him to curtail his hours. This has been going on for 15 years and I hope the county will put a stop to the business and return the neighborhood into a nice peaceful and quiet place. My neighbor Randy Kunimoto had put up a monstrosity 17 years ago to give tennis lessons at his house on 1625 Mele Manu Street. I live on 1628 Mele Manu Street and I have endured 1. The unsafe traffic conditions. 2. The noise. 3. The ugliness of the tent. For the last 17 years. Mete Manu Street used to be a nice quiet neighborhood and we purchase our existing resident because it was safe, quiet and visually pleasing. Then in 2005 the covenant of the subdivision expired and immediately thereafter Randy Kunimoto started to erect this big ugly plastic tent over his back yard. He started to offer tennis lessons. His lessons can run from 7 am in the morning to 10 pm at night. The traffic in the subdivision immediately increased at least 300 percent. I used to walk Mete Manu Street for exercise. I walked on the shoulder of the road. The shoulders are nice and wide. However I was almost ran over by Randy Kunimoto's tennis clients twice. Before the speed humps were put up on Mete Manu Street Mr. Kunimoto's tennis clients would speed up and down the hill on Mete Manu Street. I have measured the vehicular speed in excess of 50 MPH. Especially going down hill. I had confronted Mr. Kunimoto regarding his clients' driving. All he did was change the subject. Then the noise of the tennis clients and especially the tennis coaches when they yell at the kids. It was unbearable. The noise continues day and night form early in the morning to late at night. Who would want a big ugly large white tent in the middle of their neighborhood. Then as the year goes by the white tent is not turning black and even more ugly. I have written to the county department but the issue fell on deaf ears. I am hoping finally the county planning department will address the issue of these tennis lessons and the large ugly tent. We would also like to provide some background information on the impact this business has on our neighborhood. The County recently installed speed humps on Mele Manu Street because neighbors were fed up with cars going to and from Mr. Kunimoto's business speeding up and down the street. The speed humps have reduced the speeding, but the volume of cars has not decreased, and we continue to be tailgated regularly. The tailgating is especially bad on winding Kaumana Drive for his classes that start between 4:00 and 5:00 PM. These speed humps would not have-been needed if it were not for Mr. Kunimoto's business. We appreciate that Mr. Kunimoto's business provides a benefit to the Hilo community and are confident it can be relocated to a more appropriate location. I was already a kupuna at that time, and those lessons changed my life. His teaching style made me feel confident as my skill level grew, week after week. As a former physical education teacher, I appreciated his personalized, valuable suggestions, and so I continued to take lessons there for at least ten years. His covered court has been a godsend when league matches get rained out. Randy was always quick to give permission for his court's use on our many rainy match days. Randy's name is held in the very highest regard in the tennis community. His dedication to the kids' leagues is well known. The tennis successes of his students (including hundreds of all ages and kupunas, like myself) are hailed throughout Hawaii County. Since then I've seen speed humps all the way up his street. While I had never witnessed anyone speeding years ago, I can't imagine his neighbors could see that as a problem now. As an owner of a small business, I understand the struggle to operate a small business on the Big Island. The cost of business in Hawaii is extremely high. Available commercial property on the east side is very limited. The entrepreneurial effort and knowledge used to utilize Randy's existing property to lower operating cost is how many business are able to stay open and afloat. Denying this special use permit would have far reaching negative impact of Randy's ability to continue to operate and provide this asset to the community. I visit his property weekly, there are very few cars 4-5 at most and all parking is located on his property. Traffic is very minimal, I rarely pass vehicles in the subdivision to and from lessons. The facility noise is minimal, similar to any other small group enjoy time outside during daytime hours. All of Randy's clients are respectful and courteous of the area and the surrounding neighbors. Randy's has modified and made concessions to mitigate any noise or misuse complaints. I urge the committee to see the enormous benefit Randy's Kunimotos tennis program is to our entire community, do not be blinded by one loud outspoken individual, and approve this special use permit. I do not feel that Coach Randy's clients are the primary contributors to speeding, traffic, or littering in our neighborhood. • I have experienced my neighbors speeding and tailgating me in our neighborhood. • Within the past few years, they expanded our neighborhood, allowing at least seven additional homes to be built. However, I have not noticed an increase in traffic that could not be attributed to our neighborhood's expansion. • While I have noticed increased littering in the neighborhood, it is concentrated on Edita Street, where one of the exits of Kaumana Caves is located. Therefore, I do not believe it is fair to place full blame on Coach Randy and his clients regarding these concerns. It was evident that tennis was more than a source of income— he truly cared about his students and wanted them to succeed on and off the tennis court. It's been over 7 years since I graduated college and stopped playing tennis competitively. However, to this day I still feel so blessed for what Randy instilled in me and the opportunities that I was given because of his investment in me. When they asked him to cut back his hours of operation, he did that. For this single father his income took a big hit. It would be very sad if Hilo lost the services of Randy Kunimoto. He could easily be a teaching pro at any West Hawai'i luxury resort or be a tennis coach at any Division I University. Instead, his loyalty and love for Hilo kept him here and he developed year after year top 10 junior tennis players in our state. Many of those high school players have received tennis scholarships from top universities. Randy Kunimoto had the foresight over 20 years ago to build a covered tennis court so his students would not miss lessons because of rain. This was when there were very few homes in his subdivision. Randy and his staff helps bring physical and social wellness to my entire family. We take lessons to help us improve our tennis game, but most importantly, tennis helps us take care of ourselves. When all the courts were closed through the pandemic, Randy kept his lessons going with all the safety protocols in place. I'm an elementary school teacher and my wife is the rehab manager at Life Care Center of Hilo. The pandemic was such a stressful time. Never in our life we'd ever have to deal with death and sickness so close to our lives, and for a half hour to forty-five minutes every week, we could let that go to play tennis. It was the only place in town. I'm forever thankful that Randy could do this for me and my wife. The tennis community is a close community. We have fun and enjoy the game, but I'd like to think playing with integrity and being respectful to our opponent is part of the game too. It's what Randy teaches the kids and adults in his lessons. In the bigger picture, Randy is part of the Hilo community, and I'd like to think that all of us who participate in his tennis program try our best to be respectful to his Kaumana neighborhood community just as we play the game. I understand there have been noise, safety and litter complaints that are being attributed to Randy's friends and customers. Our group does not speed. Our group does not litter. Our group is not noisy. I have not witnessed any of those events occurring while I am driving to and from or while I am at Randy's property. Since my child started playing tennis under Coach Randy's tutelage at the age of eight, we have seen his positive impact, not only on her tennis game, but also on how she approaches her life. Randy Kunimoto started to erect this big ugly plastic tent over his back yard. He started to offer tennis lessons for fee. His lessons could run from 7 am in the morning to 10 pm at night. 7 days a week during the peak season! The traffic in the subdivision immediately increased at least 300 percent. I used to walk Mele Manu Street for exercise. I walked on the shoulder of the road.The shoulders are nice and wide. However I was almost ran over by Randy Kunimoto's tennis clients twice. One car was driving on the shoulder heading directly toward me. I had to jump out of the way.The other car was driving close to the shoulder and almost clipped me while I was walking. Before the speed humps were put up on Mele Manu Street, many of Mr. Kunimoto's tennis clients would drive at high speed on Mele Manu Street. I have measured the vehicular speed in excess of 50 MPH. Especially while going down hill. I had confronted Mr. Kunimoto regarding his clients' driving.All he did was deflected the situations and changed the subject. Then the noise of the tennis clients and especially when the tennis coaches yelled at the kids was unbearable.The noise continued day and night from early in the morning to late at night. Who would want a big ugly large white tent in the middle of their neighborhood.Then as the year goes by the white tent is not white anymore. It was turning black and even more ugly. I have written to the county department but the issue fell on deaf ears. I am hoping finally the county planning department will address the issue of these tennis lessons and the large ugly tent. I strongly oppose granting Mr. Kunimoto a special use permit to continue his lessons. He and his family are widely considered the face of Big Island Tennis. Mr. Kunimoto is both an accomplished player and coach. Mr. Kunimoto is a tremendous asset to our community. He has personally developed hundreds of youth in the game of tennis. Some have even earned athletic scholarships because of his efforts, making it possible for them to attend some of the best universities in the country. Although I reside more than 500 feet from his home, I have chosen to respond because I am and have been affected by his business and feel it is a nuisance. I live far enough away that I am not affected by the noise of his tennis lessons. However, I have been impacted significantly by the traffic his business generates. Randy Kunimoto lives at the very end of a residential street with no outlet. Traffic to and from his facility must travel the entire length of Edita and Mele Manu street to get to and leave his property. For 15 years the traffic to and from his facility has been a hazard to the neighborhood. He is aware of this as he has been asked to have his customers slow down on our residential road. Traffic has not slowed, and being a modern, two lane, residential street with wide shoulders, his patrons have continued to drive at unsafe speed. I have felt endangered while walking on the shoulder of Mele Manu street. The speed of this traffic has been such a problem that the County installed speed bumps along the length of Mele Manu Street which reduce the speed of his customers only at the speed bump itself. Although I understand the utility of the speed bumps, they are an annoyance for me leaving and returning home from my office in town. Additionally, I resent the added wear and tear they cause to the suspension of my car. The speed bumps would not be there if his business had not generated the volume of speeding traffic that it does. I have noticed that many other businesses (including recreational from golf to hatchet throwing) have complied with zoning restrictions and conducted their business in commercially zoned locations. His business clearly belongs on land zoned for such a business. I agree that tennis is a worthwhile sport and enriches many lives. I am glad to learn that his tennis lesson business is highly successful and he has a loyal group of customers. I believe that his business can financially succeed in a commercially zoned area, and may in fact expand since it could be conducted day and night in a commercially zoned area. It does not belong in a residential neighborhood. I would take this same position if someone in the neighborhood were to open an automobile repair or body shop, or other business which would generate significant traffic or could not be conducted from within a home office. Number of cars has not decreased. In the past, I did not place any limit on the size of my classes. The popular classes had upwards of 12 in a class, although other classes had as few as 4 or 5. However, I felt it was important to cooperate as much as possible with the neighbors who expressed concerns about the traffic and have limited class sizes to 9 although most of the classes have no more than 6; at times, there may be as little as one to three students/class. The number of cars coming to my facility has decreased. There may be more cars on Mele Manu due to increase in home construction, and the additional homes accessible only from Mele Manu, into Kristiano, and then to Pomaikai or Nanaina. Randy's clients tailgate other_vehicles. For very many years, I talked to those driving on Mele Manu for lessons at my facility about adhering to the speed limit, driving carefully, and to watch out for pedestrians, and I continue to do so. I spoke to them about tailgating since this Planning Dept. Exhibit 35 was specifically mentioned. One of the drivers mentioned that she was tailgated on three separate occasions but did not feel the need to complain to anyone about it since she drives slowly even between the speed humps (15 mph), and the car behind her was not speeding. Interestingly, this driver told me that two of the cars turned into Kristiano, and the third turned into a private driveway. However, I will do my part in trying to prevent tailgating by my students. I needed to have it installed for a number of different reasons. Students can count on successive practices even if it rains,juniors,and especially seniors benefit from not having to endure the hot sun on sunny days,and much of the noise is kept in the dome. Only a very small portion of the Coverall can be seen from Mele Manu;most people would not even see this small portion. Although at least one person may consider the Coverall ugly, for me,my kids,and my students,it is a blessing, Operating a tennis lesson business is a commercial use and is not permitted in the subdivision per the Restrictive Covenants. The Coverall is a permitted structure;I am applying for a special permit for the"commercial'aspects.
