And I know that, you know, it was used as pasture and that was one road that was there. I just <br />paved the gravel. <br />RHO: The issue really is that you did something between that existing road and <br />the highway, is what they’re claiming. You touched their highway in some fashion, which they <br />are objecting to. They’re not saying the road shouldn’t exist, whatever. It’s because you did <br />something they claim, not me, they claim that you did something. You touched their highway <br />and they don’t like it and they wanted you to do something. You haven’t done anything since <br />2004 and even before that. You were in violation. You did not have a special permit prior to <br />2004; and in 2005 you got that permit, and then you’re in violation again for various reasons. <br />And I just wanted to give you an opportunity to respond to that because I didn’t realize, I didn’t <br />know that you were already in violation prior to getting that special permit. And I’m asking you <br />whether or not, I’ll ask you a specific question, is this the way you operate? <br />MIRANDA: No. But if it’s really a concern to you, I guess I could go back and dig out <br />all the asphalt and leave it the way it was, which I think would be not the right thing to do. <br />RHO: I am not asking you to dig out the asphalt. I’m asking you whether or not <br />this is your standard operating procedure where you get three letters and you don’t respond. <br />MIRANDA: Well, I didn’t expect to get the last letter because prior to the last letter the <br />inspector came out to my place and inspected it, two different times. And I called him and he <br />came and checked and we went over it. And I never expected to get this letter. But the only <br />reason I think we got this letter is because we had to resubmit the special permit and the letter <br />gets out to all of the departments, the Police Department, the Fire Department, the Health <br />Department; and the State Department of Transportation was the only one that responded. So I <br />believe they went back to whatever was in their file; and now there’s a different guy that’s acting <br />head of the Department of Transportation so he responded in this fashion. That’s the only thing I <br />can see. And I don’t believe he talked to his inspectors. <br />WATANABE: Mr. Domingo, did you have something? <br />DOMINGO: Thank you, Mr. Chairman. When I first started on the Commission, this <br />issue or this permit was already approved and granted; and it was based on the conditions of <br />certain conditions being met as stipulated in the permit. And, you know, I know perhaps most of <br />us are critical of what has taken place and because of some of the inaction and what may have <br />seemed to be flagrant, flagrant -. <br />WATANABE: Disregard? <br />DOMINGO: Disregard to the conditions. Thank you for putting words in my mouth, <br />Mr. Chairman, I appreciate that. But, you know, Mr. Miranda at that time based his trust and the <br />whole matter into someone who was his friend also. And apparently there was not a follow- <br />through with some of the conditions in that regard and he was totally unaware of it I believe; and <br />all the times that he has come to the Commission I have a feeling that he was sincere in what he <br />was saying. And then this morning he said, “Look, I’ll do whatever I need to do based on what <br />the State Highways Division requires of me. I will do it.” Yeah?
