Other associated amendments to delete the <br /> submittal of plans to the Kona Soil and Water Conservation District (Condition G) and the <br /> submittal of an archaeological survey (Condition J) and other editorial amendments are being <br /> also requested. The transmittal includes a report detailing and justifying the request, letter of <br /> authorization, and surrounding property owner list. The filing fee of$250 is being submitted <br /> electronically. <br /> In summary,the rezoning of a 21+ acre area into Agriculture (A-5a) became effective on <br /> August 27, 1998. The request was to allow the subdivision of the subject site into four (4) 5+ <br /> acre lots. Condition D required receipt of final subdivision approval within five (5) years of the <br /> effective date of the rezoning ordinance. While an administrative time extension was granted to <br /> August 27,2008, final approval was never secured. In the meantime,the applicant acquired the <br /> property through a foreclosure less than two (2) months ago with the intent of finishing the <br /> subdivision. <br /> As such,the applicant is requesting five (5) more years, beginning the effective date of <br /> the current application, retroactive to August 2008- Alternatively, should the Department or <br /> Leeward Planning Commission elect to process this as a new application, the applicant would <br /> have no objection.
