Conveyances prior to the issuance of Final Subdivision Approval.] A cony <br /> of the recorded document shall be filed with the Planning Department upon <br /> its receipt from the Bureau of Conveyances." <br /> This condition has not been fulflled. It will, however, be done immediately <br /> upon securing tentative subdivision approval. The Applicant, however, requests <br /> that the requirement to have a recorded covenant prior to issuance of Final <br /> Subdivision Approval be deleted. Since the draft of the easement needs to be <br /> approved by the Director before its submittal for recordation, receipt of the <br /> recordation version is redundant and can be time consuming. <br /> F. "Restrictive covenants in the deeds of all of the proposed lots within the subject <br /> property shall give notice that the terms of the zoning ordinance prohibit the <br /> construction of a second dwelling unit and condominium property regimes <br /> (CPR) on each lot, including Lot 1. This restriction may be removed by <br /> amendment of this ordinance by the County Council. The owners of the <br /> property may also impose private covenants restricting the number of dwellings. <br /> A copy of the proposed covenant(s)to be recorded with the State of Hawaii <br /> Bureau of Conveyances shall be submitted to the Planning Director for review <br /> and approval prior to the issuance of Final Subdivision Approval. [A copy of <br /> the approved covenant(s) shall be recited in an instrument executed by the <br /> applicant and the County and recorded with the Bureau of Conveyances <br /> prior to the issuance of Final Subdivision Approval.] A cony of the <br /> recorded document shall be filed with the Planning Department upon its <br /> receipt from the Bureau of Conveyances." <br /> Again, this condition has not been fulfilled but will be addressed subsequent to <br /> issuance of final subdivision approval. Further,for the same reason noted <br /> above, the Applicant requests deleting the recordation requirement prior to <br /> receipt offinal subdivision approval. <br /> G. ["Restrictive covenant(s) in the deeds of the proposed agricultural lots <br /> within the subject property shall require the individual owners of the <br /> proposed lots to file a conservation plan with the Kona Soil and Water <br /> Conservation District, with a copy of the approved plan submitted to the <br /> Planning Department,prior to any Iand alteration activities within any of <br /> the respective agricultural lots. A copy of the proposed covenant(s) to be <br /> recorded with the Bureau of Conveyances shall be submitted to the <br /> Planning Director for review and approval prior to the issuance of Final <br /> Subdivision Approval. A copy of the approved covenant(s) shall be recited <br /> in an instrument executed by the applicant and the County and recorded <br /> with the Bureau of Conveyances prior to the issuance of Final Subdivision <br /> Approval."] <br /> The Applicant is requesting that this condition be deleted in its entirety. The <br /> condition is designed to address drainage concerns associated with any land <br /> 4 <br />
