H I T N E S S E T S <br /> 15622 282 <br /> Whereas, Developer has created and constructed a private <br /> water system for the benefit and use of all of those Lots located <br /> in Rualalai Farms SuMivision, Units I and II, North Kona, <br /> Hawaii; and <br /> Whereas, all lot owners in Rualalai !arms Subdivision, <br /> Units I and II, have the absolute and irrevocable right to <br /> receive such water as they require for constmption and use <br /> on their lots in said Subdivision contingent only on the <br /> obligation of such let owners to pay for such water as they <br /> may use or consume, and on the obligation of such owners to <br /> pay their proportionate share of the cost of the ssaintenance <br /> of the said water systems and utilities easements as set forth <br /> herein and further, on their obligation to purchase and <br /> install a water muter to meter all water frow the said water <br /> r <br /> system used or consumed on this lot; anA <br /> Whereas, the Developer has conveyed or will convey to <br /> Purchaser Lot 6 T of Nualalsi Farms Subdivision, Unit I <br /> Worth Kona, Hawaii, hereinafter referred to as the Lots and <br /> Whereas, all lots in nualalai Farms Subdivision, together <br /> with those other lands which may now or in the future be <br /> identified in Exhibit A attached hereto and incorporated <br /> herein by this reference, or such amended Exhibit A as may be <br /> attached in the future will jointly have access over that <br /> certain roadway more particularly described in Exhibit S <br /> attached hereto and by this reference incorporated herein as <br /> though fully set forth, and they shall further make joint use <br /> of the utilities easements also more particularly described <br /> in Exhibit N attached hereto and by this reference incorporated <br /> herein as though fully set forth; and <br /> -2- <br />
