This Agreement will be appurtenant <br /> to the prMer described as Rualalai Caries Subdivision <br /> and the praparty described in Exhibit A, if any, and in <br /> the event that the Purchaser or the holder any such lot or <br /> property shall sell his interest in the future, any and <br /> all oonveyance shall convey an undivided interest in the <br /> roadway and utility easement parcels together with all <br /> rights in this hgremmnt, including but not limited to <br /> access to the water system. The purchaser of a Lot in <br /> Nualalai Farms Subdivision and the owner of any property <br /> described in Exhibit A also covenant that in the event of <br /> the resale of his Lot or property, the buyer of his Lot or <br /> property will be required to assume all of the obligations <br /> and duties of the purchaser or Lot owner herein with <br /> respect to the repair, maintenance, and use of the water <br /> cystan, the roadway and utility easement. <br /> 3. Each Lot owner, the owners of properties des- <br /> cribed in Exhibit A, if any, the Developer and its <br /> successor in interest, the Rualalai ?arms Community <br /> Association, will be responsible for the costs of main- <br /> taining the water system, the roadway and utility <br /> easeseents in a condition similar to the condition of said <br /> water system, roadway and utility easements upon the <br /> e�plotion of the improvements contemplated by the <br /> Developer on a pro rate basis. These improvm rants consist <br /> of a twenty-foot wide asphalt paved roadway suitable to <br /> access by passenger automobiles and such improvements as <br /> may be required for water service to the various lots and <br /> other property. The lot owners and property owners <br /> described in Exhibit A, if any, will not be required to <br /> make contributions for improvements to the roadway over <br /> and above the standards set forth herein without their <br /> consent. <br />
