ar , 15622 288 <br /> and its successor in interest, the Aualalai pares <br /> Community Association, and all other roadway lot owners or <br /> utilities easement owners or users for any injury or <br /> damage suffered by the purchaser or the owner of lots <br /> described in Exhibit A, if any, or their permittees or any <br /> other persons, arising from the ownership, control, <br /> repair, maintenance, or use of the water system, of the <br /> roadway or the utilities easement and the roadway lot. <br /> A. The holders of all lots in the Hualalai pares <br /> Subdivision and all lots described in Exhibit A agree that <br /> the board of Directors of the Bualalai pares Community <br /> Association shall establish a roadway maintenance fund in <br /> an amount agreed to by said Hoard. The pro rate share of <br /> said fund shall be an assessment against each lot referred <br /> to herein and a lien against each lot. The said assess- <br /> ment shall he due and payable within forty-five (43) days <br /> alter written demand and payment may be enforced in <br /> accordance with the provisions hereinafter set forth. <br /> Said fund may be increased or decreased from time to time <br /> in the sole discretion of said Board and payment of any <br /> ants r*quir••i bocause of an increase in said fund shall <br /> be doe and payable and enforceable in the saws manner as <br /> the original assessment set forth herein. The roadway <br /> maintenance fund provided for herein shall be deemed a <br /> 'special assessment' and it shall be in addition to the <br /> 'Reqular Annual Assessments' provided for in the by-Laws <br /> of the Rualslat Farms Compunity Association. <br /> !. The purchaser, together with all other lot pur- <br /> chasers in Aualalai Farms Subdivision, shall be meters of <br /> the Ruelalai pares Community Association.
