IWASHITA: Yeah, you know, given that and there’re already allegations that there’re <br />defects procedurally in the process that the Commission has gone through in this and other <br />matters. So I just don’t see, you know, since we’re not going to have an opportunity today to see <br />Mr. Yuen’s response to this April 7, 2008 letter -. Do we have it? <br />WATANABE: I’m trying to validate that. I’m not sure because he wasn’t familiar with <br />the date. So unless he looks at it, I have no idea. <br />IWASHITA: Okay. Mr. Lim’s letter is dated April 7, 2008; my understanding is <br />Mr. Yuen did respond sometime after that. And if that’s the case -. <br />YUEN: I thought it was after that, but it may have been before. And in either <br />event, I think that both Mr. Lim and myself would agree that the Commission, if it chooses, can <br />take action based on what you have before you. And it’s only if you were to move this to <br />another meeting that I would want to submit something else. <br />WATANABE: Does that clarify it for you, Mr. Iwashita? <br />IWASHITA: Well, I would just like to have it clear on the record from the applicant, <br />right, that if we admit both of these, that there is not going to be any objections somehow to this <br />process that, you know, if we vote today and whatever the result, if it’s not favorable one way or <br />another -, if it’s not favorable to the applicant, that the submission of these documents somehow <br />would be raised as creating a procedural defect to the vote. <br />LIM: The applicant would be willing to waive, is willing to waive, or is waiving <br />th <br />that objection with respect to these two documents we are talking about, which is the April 7 <br />th <br />letter from myself to the Council and Mr. Yuen’s March 5 letter to the Council. <br />IWASHITA: Thank you. <br />WATANABE: Is that satisfactory? <br />IWASHITA: Yes. <br />WATANABE: Do we have a -? <br />LIM: I’d like to make it clear that we reserve all of our other procedural, you <br />know, objections, but -. <br />WATANABE: Okay. <br />LIM: With respect to these two documents, no problem. <br />WATANABE: Yeah, I understand.
