Special Management Area Maps.SMA Use Permit applications filed <br />prior to the adoption of amendments to this rule shall be exempted from <br />any new procedures. <br />26.Section 9-15 is amended as follows: <br />A.Any person who violates any provision of this rule shall be liable <br />for (1) a civil fine not to exceed [$10,000] $100,000; or (2) for the <br />cost of returning the affected environment or ecology within the <br />Special Management Area to the condition existing before the <br />violation. <br />B.In addition to any other penalties, any person who is violating any <br />provision of this rule shall be liable for a civil fine not to exceed <br />[$1,000] $10,000 a day for each day in which such violation <br />persists. <br />C.Any civil fine or other penalty provided under this rule may be <br />imposed by the circuit court or by the Department after an <br />opportunity for a hearing under chapter 91, HRS. <br />27.Section 9-20 A 2 is amended by increasing the filing fee to $250 for a <br />Petition for the Adoption, Amendment or Repeal of Rule 9. <br />Copies of the proposed amendments to Planning Commission Rule No. 9 relating <br />to Special Management Area are also on file and open to inspection during office hours at <br />the Planning Department, Aupuni Center, 101 Pauahi Street, Suite 3, Hilo, Hawaii and <br />the West Hawaii Office of the Planning Department, 75-5706 Kuakini Highway, Kailua- <br />Kona, Hawaii. <br />11 <br /> <br />
