The KVDC's recommendations are forwarded to the Planning Director for consideration during the review of subsequent land use approvals, including Plan Approval. Final Plan Approval must occur prior to Building Permit approval. The KVDC provides architectural and design review of projects within the Kailua Village Special District when an application requiring Plan Approval is submitted to the Planning Department, pursuant to Section 25-7-4 of the Hawaii County Zoning Code. See Section 25-2-72 of the Zoning Code for the requirements for an application for Plan Approval. Plan Approval is required for any new structure or development or any addition to an existing structure or development in all districts except the RS,RA, FA, A, and IA districts, and except for the construction of one single family dwelling and any accessory buildings per lot. Gregory Trust, State of Hawaii Project: Modifications and Improvements to Coconut Grove Marketplace Tax Map Key: 3 7-5-009:025 027 028 & 043 We have reviewed the subject Special Management Area Use Pen-nit Assessment Application (SAA 19-001673), originally submitted on December 10, 2018, with additional infonnation submitted to the Department on March 7, 2019, March 11, 2019, and April 16, 2019. The applicant proposes the following modifications and improvements to the Coconut Grove Marketplace complex: ■ Improve landscaping area around volleyball court (Parcel 043), including grading and terracing to create more usable flat space, construction of 110 linear feet of rock retaining walls, installation of 195 square feet of concrete pads at day use table areas and installing a safety net/fencing on the makai side of the volleyball court to stop volleyballs from entering Ali`i Drive. Replace existing awnings of wood, metal, and canvas construction with a new, single construction awning over Bongo Ben's lanai (Parcel 027). Replace wooden stairs and construct a new, low-sloped, wood-framed roof structures over the entry stairs Ieading up to Laverne's and the Lanai that connects Laverne's to the ABC Stores building to the north (Parcels 025 & 027). The proposed improvements would to create a safer, less slippery access to the facility as well as creating an improved aesthetic. The anticipated cost of the proposed improvements is $450,000. The subject parcels are zoned Resort-Hotel (V-.75) by the County and designated Urban District by the State Land Use Commission. The parcels are primarily designated Resort Node (ren), but also have smaller areas designated as both Open (0) and Medium Density Urban (mdu) by the Hawaii County General Plan Land Use Pattern Allocation Guide (LUPAG) Map. The parcels are located entirely within the Special Management Area (SMA), but are not located in a "shoreline area" as defined by Section 205A-41, Hawai`i Revised Statutes (HRS). Pursuant to Hawaii Revised Statutes (HRS) 205A-45 and County of Hawaii Planning Department (PD) Rules of Practice and Procedure Section 11-5(a) Establishment of Shoreline Setback Lines, "Except as otherwise provided in this section, all lots i,,,hich abut the shoreline shall have a minimum shoreline setback line of ferry feet". On December 28, 1988, the Planning Commission granted a Shoreline Setback Variance(SSV 641) covering Parcels 025, 028, and 043, which allowed the construction of a commercial specialty center and related improvements, portions of which. were situated within the shoreline setback area. With the exception of the proposed installation of safety netting znakai of the volleyball court on Parcel 043, all of the other improvements are proposed to take place outside of the shoreline setback area. The proposed installation of safety netting is covered under SSV 641, Special Management Area Determination: SMA Use Permit No. 277 was granted by the Planning Commission at a public hearing on December 28, 1988, along with the previously mentioned Shoreline Setback Variance, to allow the development of a commercial specialty center and related improvements on Parcels 025, 028, and 043. SMA 277 was amended by the Planning Commission at a public hearing on Shani Armbruster Tinguely Development July 9, 2019 Page 3 September 27, 1990, to include a .338-acre lot to be developed as a passive park in the center of the commercial complex. SMA Use Permit No. 265 was granted by the Planning Commission at a public hearing on December 28, 1988, to allow the development of a restaurant, retail shops and related improvements on Parcel 027. After careful review of the subject request, the Planning Director has determined that the proposed renovations are consistent with and covered under the above-mentioned permits. It is the landowners' responsibility to adhere to all conditions set forth in SMA Nos. 265 and 277 and SSV No. 641. While further review of the proposed improvements against the Special Management Area rules and regulations will not be required,many of the proposed improvements encroach within the front and side yard building setbacks on the subject parcels. For your information, there is an existing front yard setback variance (VAR 1243) situated on Parcel 027. Based on the preceding, will you will need to secure a setback variance or an amendment to an existing variance for any work that will encroach within the setback. Moreover, all other applicable Zoning and Building Code requirements must be satisfied. Please be inforined however, that the proposed replacement of wooden stairs and construction of a new, low-slopcd, wood-framed roof structures over the entry stairs leading up to Laverne's and the lanai that connects Laverne's to the ABC Stores building to the north would cross the property line between Parcels 025 and 027 and therefore cannot be granted a variance. Finally, any farther development not included in this approval shall require further review and approval as provided under Chapter 205A, HRS, and Rule 9, Planning Commission Rules of Practice and Procedure.
