(SEE EXHIBIT C) <br />The Commission took up the following item at 10:45 a.m. with one person from the public in <br />attendance: <br />APPLICANT: MICHAEL ROGERSON dba THUNDER ALLEY AUTOMOTIVE (SPP 11- <br />114) <br />Application for a Special Permit to allow the establishment of an automotive restoration repair shop, <br />storage area and accessory uses on 32,000 square feet of land situated on a larger 2.38-acre parcel <br />within the State Land Use Agricultural District. The property is located along the west side of <br />White Road approximately 1,650 feet south from its intersection with <br />nd <br />Highway), Pu‘ukapu Homesteads, 2 Series, South Kohala, Hawai‘i, TMK: 6-4-018: portion of <br />033. <br />Mr. Darrow stated that the Department had received a letter from the applicant, dated March 16, <br />2011, withdrawing his application. In response to Commissioner Housel’s question, he confirmed <br />that the filing fee for the petitions for standing in a contested case hearing would be refunded to the <br />two petitioners since the hearing had not commenced. <br />MINUTES - The Commission took up the following minutes at this time, 10:48 a.m. <br />February 17, 2011 – In response to the Chair’s concern regarding how commissioners’ attendance <br />was seemingly recorded inconsistently, Mr. Arai explained that transcripts were specific to each <br />agenda item whereas summary minutes were for the entire meeting. For example, if a commissioner <br />came late and totally missed the hearing of an item, the commissioner would be recorded as absent <br />for the particular transcript, while the summary minutes would show the same commissioner as <br />present, with a notation of the time he/she joined in. It was then moved by Commissioner Iokepa <br />and seconded by Commissioner Hickcox that the minutes be approved as circulated. Motion was <br />unanimously carried by a voice vote of all Commissioners in attendance. <br />ADMINISTRATIVE MATTERS – The following was reported under administrative matters: <br />William C. Foulk Contested Case (SMA 10-41) – Mr. Arai stated that the applicant had withdrawn <br />his application, and that the contested case hearing planned for June was therefore cancelled. He <br />th <br />added, however, that a regularly scheduled meeting for June was still set for the 16. <br />Ms. Mecklenburg had nothing to report. <br />ANNOUNCEMENTS – Mr. Arai announced that the next meeting on April 21, 2011, would be <br />held in the Community Center at the West Hawai‘i Civic Center. <br />This meeting being Commissioner Housel’s last meeting, Mr. Arai expressed his gratitude to <br />Commissioner Housel for his dedicated service to the County. Commissioner Housel responded by <br />thanking for everyone’s support over the years. <br />Mr. Arai said that there was potentially a contested case in the near future, and apprised the <br />Commission of budget constraints on contested cases. <br />2 <br /> <br />
