MINUTES The Commission took this item up at 2:50 p.m. with <br /> one person from the public in attendance. <br />December 1, 2006 – It was moved by Commissioner Siracusa and seconded by <br />Commissioner Galdones that the minutes be approved as circulated. Motion was <br />unanimously carried by a voice vote of all Commissioners in attendance. <br />ADMINISTRATIVE The Commission took up the following under <br />MATTERS Administrative Matters at this time, 2:51 p.m.: <br />Appeal of Daniel Ibbetson (SPP 05-015) – Mr. Torigoe briefly summarized the Third <br />Circuit Court’s Notice of Judgment and Order in reversing the decision of the Planning <br />Commission and remanding the case for further proceedings. He suggested this matter be <br />placed on the Commission’s next agenda to discuss whether the Commission wishes to <br />appeal the Circuit Court’s decision to the Supreme Court and/or how to proceed with the <br />Court’s order, noting parties will be in attendance at this meeting. He suggested the <br />agenda state that there will be a possible executive session for the Commission to discuss <br />legal matters with its counsel. Upon the Commission’s request, Mr. Torigoe stated he <br />will be providing the Commissioners with a written analysis of the matter on what <br />options were available to the Commission and its legal ramifications. Mr. Torigoe said <br />the Commission should hear the parties’ arguments on whether to reopen the contested <br />case hearing before the Commission makes such a decision. <br />ANNOUNCEMENT The following announcement was made at this time, <br /> 2:59 p.m. <br />ADJOURNMENT There being no further business, the Chair declared the <br />meeting adjourned at 3:00 p.m. <br /> Respectfully submitted, <br /> Sharon M.
