complex of features with 12 features (Site 30482). The identified <br /> features consist of nine modified outcrops, two mounds, one terrace, <br /> one lava tube and one wall. Functionally the features consist of <br /> agricultural (12), livestock control. (1) and temporary habitation (1)." <br /> The report went on to note that the sites in the project area "yielded <br /> information important for understanding historic ranching activity in the <br /> area and probable prehistoric, traditional Hawaiian habitation and <br /> agriculture use." As such, they were assessed as "significant solely <br /> for their information content' and that "no further work or preservation <br /> is recommended. The landowner's plans for the property will have no <br /> effect on the historic properties based on the survey findings." <br /> Please note that in the event any inadvertent discoveries are made <br /> during any land disturbance activity relating to this project, work will <br /> cease, and the Applicants will immediately notify the Planning <br /> Department and the State ❑LNR and secure their clearances before <br /> proceeding further. <br /> E. Valued Cultural Resources <br /> The recent Hawaii State Supreme Court's "PASH" and "Ka Pa'akai 0 <br /> Ka'Aina"decisions require decision-makers to consider a project's <br /> impact to native Hawaiian gathering and fishing rights. Specifically, <br /> there must be a discussion of the cultural, historical, and natural <br /> resources and associated traditional and customary practices of this <br /> site and the impact of this project to these resources and practices. <br /> In this situation, the subject site is not adjacent and/or proximate to the <br /> shoreline. As such, gathering of marine life and coastal access is not <br /> an issue. <br /> It is not known whether the subject or immediate surrounding area <br /> was used in the recent past for the gathering of plants by native <br /> Hawaiians. Almost all of the existing vegetation on the parcel now <br /> consists of introduced plant species. Further, the Applicants have not <br /> observed any native Hawaiians on the site or adjoining properties <br /> gathering plants in recent times. Thus, it would appear unlikely that <br /> the site would serve such purpose today. <br /> The cultural impacts, if any, thus appear to be non-existent. However, <br /> in the event legitimate gathering claims are made by native <br /> Hawaiians, the Applicants intend to respect and honor such claims <br /> and provide the needed access within the site. <br /> 12 <br />
