OULI, <br />SOUTH KOHALA <br />APPLICANT: SCOTT NAKAHARA (REZ 06-000031) <br />a.State Land Use boundary amendment from the Agricultural to the Rural district for <br />approximately 5.9 acres of land. <br />b.Change of Zone from Agricultural 5-acre (A-5a) to Residential and Agricultural 2-acre <br />(RA-2a) for approximately 5.9 acres of land. <br />The property is located along the south side of Kawaihae Road (Highway 19) with access from <br />Kanehoa Place, Kanehoa Estates Subdivision, Ouli, South Kohala, Hawaii, TMK: 6-2-9: 17. <br />(SEE EXHIBIT B) <br />YUEN:While we are between items I just wanted to make a comment to the <br />Commission about a statement that was made in the earlier matter about Commissioners <br />testifying and just to clarify when Commissioners can talk about their own life experiences. <br />ALAMEDA:Sure. <br />YUEN:A Commissioner can always talk about things that they are aware of from <br />general knowledge in the community or their own experience. For example, if you work for a <br />financial institution you can talk about whether a certain kind of condition would cause a <br />problem with somebody getting a loan on the property. You can talk about your experience in-, <br />if the question is whether there should be a traffic calming device like a speed bump you can <br />testify about well we have a speed bump in our neighborhood and it causes a lot of noise when <br />the cars go over it. You can always talk about those kinds of things. When we have a matter <br />that the Commission is deciding, like a permit where the Commission is final and not a <br />recommendation you have to be cautious about talking about specifics of the site that are not on <br />the record. In other words I know theres a big lava tube on that site, the bulldozers going to fall <br />through. If youre aware of something like that you should try to bring it out by asking a <br />question rather than by your being the source of the facts on it. But as far as knowing, saying <br />that the traffic is bad in Kona or a stub out in my neighborhood causes a problem and that might <br />cause a problem in a situation like we had in a particular subdivision application, you can always <br />do that kind of statement. <br />ALAMEDA:Any clarification fellow Commissioners on that particular matter?
