Mya Pawu was here at the last hearing and did give public testimony on this. And, therefore, <br />thats an error; and I would like to see it go into the record thatthat was, that line is in error. <br />DARROW:Ifits okay, if we could just add in a small addition, the word all, is <br />made without the benefit of all public testimony. And that would just beadded within the <br />recommendation. That way at least it will make it clearer that this recommendation was given <br />without all public testimony. <br />SPRINGER:So thats on the third line of the first page. <br />DARROW:Correct. <br />IWASHITA:Madam Chair? <br />SPRINGER:CommissionerIwashita. <br />IWASHITA:Becausewereredoingthisbaseduponthenoticeissueand,Iguess,my <br />perception is that what happened before is sort of like washed out and so we need to make, and if <br />it, we really need to make a new record today, right, in order -? Whatever action we take today <br />is just based on todays record? And it seems to me the notice issue puts into question what was <br />presented last time because it was technically not proper to do so. So, in that light, maybe its <br />legalese, but I think the statement in the recommendation is correct, if you look at it that way, <br />that we really cannot consider that other, you know, the old hearing. <br />SPRINGER:Thank you, Commissioner Iwashita. Mr. Torigoe, can you comment on <br />this? <br />TORIGOE:Well, at this point have we had any requests for contested case <br />intervention? <br />DARROW:No, we have not. <br />TORIGOE:No, okay. If there is no one who is asking for intervention, then we may <br />be able to cure that and save some trouble by simply having, basically, incorporating the prior <br />record into todays proceedings, if there is no objection from the applicant and if theres no other <br />party that actually has standing to object to that, and if the Planning Director is agree able. <br />SPRINGER:Commissioner Iwashita. <br />IWASHITA:I would be willing to make such a motion if the Chair would entertain it. <br />SPRINGER:Mr. Director, do you have any comments? <br />YUEN:Thats fine with me. <br />SPRINGER:Commissioner Iwashita? <br />5EXHIBIT B <br /> <br />
