INITIATOR: PLANNING DIRECTOR Amendment to certain sections of Chapter 23 (Subdivision Code), Hawaii County Code 1983 (2005 edition) regarding the subdivision review and approval process, including but not limited to information required for the submittal of an initial subdivision application, revision to certain time requirements, grades and curves of streets, and housekeeping changes to the languages within various sections of the code. November 18, 2005 It was moved by Commissioner Springer and seconded by Commissioner McCall that the minutes be approved and placed in the file. ADMINISTRATIVE MATTERSThe Commission took this item up at 5:47 p.m. with approximately 5 people from the public in attendance. Deputy Corporation Counsel Ivan Torigoe informed the Commission that on the Ainahoa Development Corporation Use Permit Application that was approved by the Commission there was a request to change one of the major conditions which had to deal with Ainaloa Boulevard that required the developer to pay approximately 6 million dollars and was requesting that it be cut down to 1 million and the Commission denied that. Mr. Torigoe said that the request went up on appeals before Judge Hara and Judge Hara has ordered the Commission into settlement conference. Commissioner Graham has agreed to try and make himself available to represent the Commission along with Mr. Torigoe. Judge Hara has been trying to arrange conferences on Saturdays but Mr. Torigoe will keep the Commission apprised. Mr. Torigoe stated that if theres any agreement among the other parties obviously and if the Judge wants the Commission to consider a settlement then that will be brought forth to the Commission for their consideration.
