b.SpecialManagement Area Use Permit to allow the development of sixty-seven (67) <br />multiple family residential units and commercial spaces within a 45-foot high structure, <br />and related improvements. <br />The property is located on the mauka side of Alii Drive across from Huggo's Restaurant <br />rd <br />and the Royal Kona Resort Hotel complex, Kailua-Kona, Puaa 3, North Kona, Hawaii, <br />TMK: 7-5-9:23. <br />KPC VILLAGESThe Commission took this item up at 9:35 a.m. with <br />LLC.approximately 30 people from the public in attendance. <br />rd <br />PUAA 3, <br />NORTH KONA <br />APPLICANT: KPC VILLAGES, LLC (SMA USE PERMIT NO. 276) <br />Revocation of Special Management Area Use Permit No. 276, which allowed the development <br />of a 48-unit condominium project and related improvements. The property is located on the <br />mauka side of Alii Drive across from Huggo's Restaurant and the Royal Kona Resort Hotel <br />rd <br />complex, Kailua-Kona, Puaa 3, North Kona, Hawaii, TMK: 7-5-9:23. <br />Chairperson Springer presented the basics of the application to the Commission. <br />Mr. Hayashi stated that the Applicant€s Representative Sandra Song submitted a request to have <br />this item and agenda item number 5 continued to the next Kona Commission meeting. <br />Ms. Song was sworn in and then proceeded to explain to the Commission that they are <br />requesting a continuance because when the application was filed in 2004 notices were sent to the <br />adjoining property owners within 300 feet according to thelist provided by the tax records. She <br />said that subsequently when they received notice of the Planning Commission hearing they again <br />sent out notices to adjoining property owners fromthe current tax records. That notice was sent <br />ndth <br />out on May 2. On May 11 she received a letter from the manager of the Kona Billfisher <br />Timeshare Condominium Resort Project with the noticeand alist of 780 timeshare owners <br />requesting that she serve the notice to all 780 timeshare owners. She stated that between May <br />thth <br />12 and 16 all 780 owners were served. However the meeting date was so close that the <br />Applicant felt in fairness to all they continue this another month so that new notices can be sent <br />out and then there will be no objection about timing. She further stated that they understand that <br />if this is continued that the time for the Contested Case filing is also continued to the next <br />hearing. <br />There were no questions for the Applicant€s Representative from the Commissioners. <br />On agenda item number 4, KPC Villages, LLC, REZ 04-033/SMA 04-009 it was moved by <br />Commissioner Alameda and seconded by Commissioner McCall to approve the request for <br />continuance to the next Kona meeting. Motion carried with 6 ayes by roll call vote of all <br />Commissioners present. <br />4 <br /> <br />
