RHO: Yes. <br />ATTA: Same exhibit. <br />RHO: Same exhibit. My understanding is the Board of Water Supply says <br />they only, or you don’t have enough commitment for water. And you folks are saying that <br />you do based on this LEED registered project. <br />ATTA: Yes. <br />RHO: But in that same paragraph you folks write “As such, the water <br />demands for the project should be at least 30 percent less than that of traditional residential <br />subdivisions. Applicant is also exploring the option of participating in privately owned water <br />systems that will eventually be dedicated to the County.” So it, the way I read it is you’re not <br />really sure that whatever you guys are doing in terms of green is going to cover that water <br />commitment; therefore you’re going to explore this private water system. So I just wanted a <br />clarification on that. <br />ATTA: The private water system is Plan B; and I think that this notion of a <br />LEED water reduction thing, it’s a new thing in Hawaii. And I don’t think there’s a <br />neighborhood development in Kona that’s 100 percent LEED. So we’ve done our <br />calculations, we’ve worked with our landscape architects with the different kinds of design <br />features and measures for reducing the demand and based on our calculations we can meet it. <br />But, you know, and the Board of Water, and we’ve been talking to them, they said, okay, <br />sounds like a good idea but how can we be sure that it will work; and so we provided backup <br />information from the mainland and EPA statistics and they’ve been, basically saying, okay, <br />we’re willing to give it a try but they don’t want to be stuck with a situation where for some <br />reason we might not make it like -. And so there’s, I guess, an agreement with the <br />Department of Water Supply that we will monitor, as we’re developing the project, there will <br />be a master water meter to kind of watch whether we are actually are meeting our 30 percent <br />or more water reduction targets. And after 50 units which is the number of credits we have <br />based on the standard thing there will be an assessment. And if we’ve shown that we <br />actually are meeting those targets then they’re okay with the additional 15 units. So it’s a, <br />kind of like almost like a performance based agreement. You know, if we can show we can <br />do it, then they’ll be okay with 65 units. If, you know, as we’re developing we’re not <br />showing that we can prove it, then we’ll be, you know, we’ll stay within the traditional <br />amount; and that’s what it is. And so from our side we have been talking about getting <br />additional water credits. That’s as a Plan B. Our Plan A is to do this LEED and to make it <br />work. <br />RHO: And then on that last paragraph you write “Development of the <br />property is not expected to have any significant impact on the area, roads” and then it goes on <br />to “sewers, drainage police and fire protection.” But from what I’ve read, in the short time <br />that we’ve had your documents, all the documents, there seems to be a problem with the <br />roads. I mean, it’s, you have, well, from what I’ve read there are conflicting statements as to <br />EXHIBIT B <br />13 <br /> <br />
