Merit Appeals Board March 29, 2018 <br />Lee and I were recently, this past Friday, we were—we participated in the Fire BC's <br />Intermediate Court of Appeal court ordered medication. So, we were at the courthouse with the <br />mediator for the day in an attempt to settle the current appeal by the battalion chiefs. <br />Unfortunately, we weren't able to reach agreement, but I think we have a good understanding <br />going forward as to what the primary concerns are. I'm not sure the demands from the battalion <br />chiefs are really high, really expensiveI'm not sure if we'll be able to satisfy their wants, their <br />demands. But I can tell you this, the department prevailed through the MAB appeal and we also <br />prevailed through the Circuit Court hearing—we were found the County was found to be <br />conducted our to be proper in the position we took. So, the court sided with the County on—in <br />both occasions both the MAB and the court. And, going forward, it's ICA we never know <br />what's going to happen at the ICA. They're going to <br />CHR. TULANG: What's "ICAT' <br />MR. BRILHANTE: Intermediate Court of Appeals—so we never know what's going to happen <br />`cause that's an independent body and they, kind of, look at the record and they make a <br />determination. <br />Craig can correct me, but my understanding is that the written briefs have already been submitted <br />to the ICA and now they're just— <br />MR. <br />ust <br />MR. MASUDA: I don't think so. <br />MR. BRILHANTE: Oh, (inaudible) briefing scheduled—is in place? <br />MR. MASUDA: Yes. <br />MR. BRILHANTE: Okay. So, we're just, kind of, going forward with that. So, what happens is <br />ICA makes a determination—whoever prevails is happy. Whoever doesn't prevail, I'm sure will <br />request that the Supreme Court take jurisdiction over the matter and they take a second look at <br />the case as well. And so, that's what we're anticipating that this is just Step 3 in a 4 -step <br />process. And so, we'll just go forward from there. <br />And just got off the phone this morning with Corp. Counsel, we're going to continue <br />negotiations with the former battalion chiefs as well, going forward. So, hopefully, we can reach <br />some type of resolution. I'm not sure if we can, though, but we are in discussions. <br />MS. NAMAHOE: Can you please jog my memory, are they still with the Fire Department or are <br />they— <br />CHR.
