condominium owners association, the idea about an educational fund could be worked through <br />something like that. Maybe Mr. Savio or somebody else could say whether thats a possibility or <br />not. But its my understanding that organizations can always decide to set up funds for special <br />purposes and set aside a certain percentage of monies to go into that fund. So it seems to me like <br />that would be doable within the group itself. <br />As far as the permanency in Ag of these parcels, I would ask Mr. Yuen if he would respond to <br />that. <br />ALAMEDA:Mr. Yuen. <br />YUEN:On the question of a permanent land use control, lets, let me separate <br />those, theres the government side and theres the private side. On the government side you <br />cant tie the hands of a future government making a decision. We have, we currently have a <br />zoning,andwehaveaGeneralPlanforKau,andwehavezoningandaGeneralPlanforthe <br />whole island. So the current General Plan for this part of the island, for this part of Kau, is <br />Important Agriculture. So, and then the zoning is 20-acre lots; and what theyre here for is to <br />rezone in a way that would allow some smaller lots, and roughly double the number of lots that <br />you could make there. <br />Now this, if its approved now its because, and just so everybody understands what the roles are <br />here of everybody, Im the Planning Director. Ive a full-time job working for the County; and <br />Im responsible for land use planning. The folks sitting here are the Planning Commissioners. <br />Theyre appointed by the Mayor, theyre volunteers, they dont get any money for this. I make a <br />recommendation to them and to the County Council. The County Council which you do vote for <br />has a final say on whether this zoning, rezoning goes through or not. But you cant, we cant put <br />in an ordinance that says it will forever be agriculture because in 20 years, 30 years, 40 years, the <br />people that are elected to take care of the communitys business, the government at that time, <br />cant be blocked by what we decided today. So, so you cant do it on a government side. It <br />would be, it would be general planned. If somebody wanted to do something different from <br />agriculture in the area, they would have to change the General Plan. So that theres that level of <br />control, but it could be changed in the future. <br />On the private side, the private person can put a, a restrictive covenant on the property that keeps <br />it in agriculture, but thats, thats on a private level of control. <br />ALAMEDA:Thank you. Any other question for the applicant? I mean -. <br />REPLOGLE:May I say something? <br />ALAMEDA:Go ahead. <br />REPLOGLE:As far as agricultural easement, I realize that that would be more the <br />landowner to do, that he should do that. So you say, okay, you can have your condominium or <br />whatever, and it would be put into an agricultural easement that would stay in place forever, <br />thats it. The government would have nothing to say about it. Mr. Savio would do it. And <br />whoever comes after just has to live with that. Thank you. <br />23 <br /> <br />
