Merit Appeals Board <br />Unfinished Business (Item 7) <br />December 16, 2021 <br />Discussion Regarding An Opinion From Hawaii County Board Of Ethics Received By <br />Merit Appeals Board Member Gabriella M. Cabanas, Concerning Whether She May Have <br />A Conflict Of Interest On Any Future Appeals Filed Against The Acting Director Of <br />Human Resources Before The Merit Appeals Board <br />CHR. CABANAS: Next on the agenda is Number 7, "Unfinished Business (for discussion and <br />appropriate action" -7) A). <br />Basically, what has happened was I was initially scheduled to appear before the Board of Ethics <br />on November 10, 2021. There they had an error on my petition request on their Board of <br />Ethics agenda. It was not listed how I had it submitted. <br />So, I'llalthough I appeared for the November 10h meeting, they had to re-agendize my <br />petition, so it got scheduled again for the December 6' meeting for which I appeared in person <br />and I submitted my testimony. <br />And the conclusion, the opinion of the Board of Ethics, is that I am not in any conflict to hear <br />any future appeals that may be filed against the Acting Director of Human Resources. So, I just <br />wanted to explain that and does anyone have any comments or questions? No? Okay. Cabanas, Concerning Whether She May Have <br />A Conflict Of Interest By Participating In The Selection/Recruitment Process For Filling <br />The Position Of The New Director Of Human Resources <br />CHR. CABANAS: And so, moving on to 7) B). At the December 6h Board of Ethics meeting, <br />the Board of Ethics determination was that I am not in any conflict to participate in the selection <br />and recruitment process for filling the position of the new director of human resources. <br />So, with that, they just said that if any of us—any Board member may have a potential or viewed <br />as a conflict that we should share it with each other at a Board meeting. And so, they said I can <br />proceed. <br />And so, with that, I'm very relieved actually. And so, I would welcome any comments or <br />questions that my fellow Board members may have on me now participating in the recruitment <br />and interview and selection process for the next director. <br />MR. KUNZ: I have a question for Counsel. So, what nth degree do we go to, like, if a third <br />cousin, that's my brother that we actually step into this area of needing to be recused? <br />Page 10 <br />
