WATANABE: So then,isit your testimony that, to some degree, you do have <br />Mr. Scotts authorization to withdraw assuming that the road is relocated? <br />ALLEN:Its my understanding that was his only objection to the project, was that it <br />was going to be located along, the roadway was going to go along -. I have not had a <br />conversation with him that specifically states that he wants to withdraw his Contested Case <br />Hearing. <br />ALAMEDA:Commissioner Graham? <br />GRAHAM:My sense of the situation is that we can gather he probably wants to <br />withdraw, but we dont have any real concrete evidence he does. So my sense would be that we <br />bypass him in our consideration for a moment and then if we approve others in a Contested Case <br />Hearing so that we know were going to have a Contested Case Hearing, thenwe can go back <br />andpickhimupandgranthimstanding,also.Thenhecanchoosetopulloutofit.Butifhe <br />turns out to be the only one, then weve got a real issue to deal with; but we may not get to that <br />point. <br />ALAMEDA:Okay. Well, then, if we do that and were okay with that and theres no <br />objection to that, then weve got Mr. Allen standing right there; and you could tell us if you want <br />to withdraw. <br />ALLEN:Again, we will withdraw the Petition. And the only reason why that I <br />attended this is that I understand that theres a Contested or application for Contested Case for <br />the location of the road now and I just didnt want to withdraw my Contested Case application <br />and the road moved back. So if I can get the assurances of that, aye, were good, well withdraw. <br />And Im sure Karen would, I cant speak for Karen but . <br />ALAMEDA:Okay. Commissioner Galdones? <br />GALDONES:Mr. Chair, thank you. In light of the statement that was made by <br />Mr. Allen, Im going to withdraw my second to Commissioner Watanabes motion to grant <br />standing on the Petition that was filed by Malcolm and Virginia Scott. <br />ALAMEDA:Okay. Commissioner Salavea? <br />SALAVEA:Can I ask Mr. Allen, approximately how far is the road located in its <br />present location away from where you folks live? <br />ALLEN:Couple hundred feet, 200 feet, 300 feet, Im not exactly sure. <br />MOOERS:Four hundred. <br />ALLEN:Four hundred. <br />MOOERS:Four hundred feet.
