A roll call vote was taken and motion carried with six <br />ayes (Springer, McCall, Thibadeau, Alameda, Graham, Fujikawa) and two absent and <br />excused (Smith and Galdones). <br />REZ 04-007The Commission took this item up at 9:26 a.m., with <br />GERALD YAMADAapproximately 18 people from the public in attendance. <br />WAIAKEA HOMESTEADS, <br />SOUTH HILO <br />APPLICANT: GERALD YAMADA (REZ 04-007) <br />Change of Zone for 4.335 acres from an Agricultural 3-acre (A-3a) to a Single Family <br />Residential - 10,000 square foot (RS-10) district. The property is located along the south <br />nd <br />side of Haihai Street, across from Hanohano Street, Waiakea Homesteads 2 Series, <br />South Hilo, Hawai‘i, TMK: 2-4-38:8. <br />Mr. Hayashi oriented the Commission and public of the subject and surrounding <br />properties on the location map and site plan, summarized the request, and noted the <br />Planning Director is recommending approval of the application with conditions. He said <br />Derick Togashi and Iris Tsuchiyama, whose correct tax map key is 2-4-37:83, expressed <br />their concerns regarding their particular subdivision having a through street and having <br />ohana dwellings on the lots proposed. <br />The applicant, Gerald Yamada, and his representative, Sidney Fuke, were in attendance. <br />Mr. Fuke stated that they agreed with the staff’s background report and recommendation. <br />He said there will actually be no improvements within the floodways, noting there will <br />not be any cross street connections between Haihai and the Puna side of the subdivision. <br />He added that there will also be a commitment to have CC&Rs that would prohibit <br />construction of an ohana or any additional dwellings on the 9 lots. <br />Upon Commissioner Springer’s inquiry, Mr. Fuke said except for notifying surrounding <br />property owners of the layout of the proposed subdivision and the no ohana restriction, he <br />has not had any personal contacts with Derick Togashi or Iris Tsuchiyama to describe the <br />configuration and circulation pattern. <br />Commissioner Thibadeau said he would feel more comfortable if there is a covenant in <br />the deed restrictions that say the roadways and drainage area will be maintained by the lot <br />owners in the area, to which Mr. Fuke stated they would have no objections. <br />In response to Commissioner Springer’s inquiry, Mr. Fuke clarified that the deed <br />restriction would have the maintenance of the roadways be the responsibility of the <br />respective property owners, inasmuch as six of the lots have their access from Haihai <br />Street and three of the lots from Palolo Street, and the maintenance of the drainageway be <br />the responsibility of all of the lot owners, noting they may have to form an association. <br />For Mr. Graham’s information, Mr. Fuke said any time there is an additional lot created, <br />3 <br /> <br />
