The property is located along the south side <br />of Keokea Park Road, approximately 1,500 feet from the Keokea Park Road – Akoni <br />Pule Highway intersection, Niulii, North Kohala, Hawaii, TMK: 5-2-12:14. <br />(SEE EXHIBIT D) <br />MINUTESThe Commission took up the following minutes at this <br />time, 11:18 a.m. <br />March 19, 2004 – It was moved by Commissioner Springer and seconded by <br />Commissioner McCall that the minutes be approved as circulated with a correction on <br />th <br />Exhibit A, page 7, sixth paragraph, 8 line, changing “in-field” to “infill.” Motion was <br />unanimously carried by a voice vote of all Commissioners in attendance. <br />ADMINISTRATIVEThe Commission took up the following matters at this time, <br />MATTERS10:21 a.m. <br />Status of appeals filed on Planning Commission decisions – Corporation Counsel – <br />Ms. O’Toole noted that the appellants for the Geiger appeal have filed their briefs in the <br />Supreme Court and the Commission’s and the Director’s briefs are due shortly. <br />Other Commission matters – Mr. Hayashi reported that the Planning Department has <br />established new procedures in the selection of hearings officers because of procedural <br />problems, noting the Deputy Planning Director who is the appointing authority <br />designated by the Planning Director cannot be part of the selection committee. He said <br />the Selection Committee will consist of the Board of Appeals Chair or designee, the <br />Planning Commission Chair or designee, Alice Kawaha who is staff to the Board of <br />Appeals, and Norman Hayashi who is staff to the Planning Commission. He said the <br />selection committee will be establishing a list of hearings officers to be used on a <br />rotational basis. <br />The Chair stated for the record that if he cannot attend the Hearings Officers Selection <br />Committee’s meeting, the first vice-chair of the Commission will be his designee, and if <br />the first vice-chair is unable to attend then the second vice-chair. <br />Upon Commissioner Springer’s inquiry, Mr. Hayashi said although the funds for the <br />hiring of hearings officers are currently running low there are sufficient funds for the <br />contested cases currently before the Commission, and he added that the Planning <br />Department will be budgeting “x” amount of money for the next fiscal year hearings <br />officers. <br />ADJOURNMENTThere being no further business, at 11:22 a.m., it was <br />moved by Commissioner Springer and seconded by <br />3 <br /> <br />
